Heard on I.A.No. 6987/2021, an application u/S. 5 of the Limitation Act for condonation of delay.

As per Registry's Report, delay is of 90 days. Appellant has satisfactorily explained the cause for delay. Hence, application I.A.No. 6987/2021 is allowed. The delay of 90 days in filing this appeal is accordingly condoned.

I.A.No. 6988/2021, an application for grant of stay under Order 41 Rule 5 of the Code of Civil Procedure, 1908 is taken up.

The present applicants are not party before the trial Court and in the execution proceedings and they are claiming their rights over the disputed land through registered sale deed. Therefore, it is directed that till the next date of hearing, execution proceedings regarding impugned judgment and decree dated 29/6/1996 passed in CS..No. 24A/1996 shall remain stayed.

Issue notice to the respondents. PF within 7 days. Office is directed to requisition the record. List thereafter.
