Shri A.S.Baghel, learned counsel for the respondent No.4. Learned counsel for the petitioner submits that the controversy

involved in the present case has been settled by this Court in Writ Petition No.2110/2010 (Ram Kumar Kapoor and others Vs. State of M.P. and others) decided on 15.03.2011, which was subsequently followed in the case o f Raghuveer Singh Jhala Vs. State of Madhya Pradesh and others Writ Petition No.19297/2018 decided on 05.03.2019.

Learned counsel for the State could not dispute the fact that the matter is identical to the order passed in Writ Petition No.2110/2010 (Ram Kumar Kapoor and others Vs. State of M.P. and others) and following the aforesaid judgment Writ Petition No.19297/2018 (Raghuveen Singh Jhala Vs. State of

Madhya Pradesh and others) has already been disposed of vide order 05.03.2019.

In such circumstances, the recovery orders are quashed. The petitioner is directed to file a representation along with the copy of this order to the respondents/authorities and the respondents /authorities are directed to consider and decide the representation and extend the benefits to the petitioner in the view of the law laid down in the case of Ram Kumar Kapoor (supra) and Raghuveen Singh Jhala, (supra). The exercise be completed within a period of three months from the date of receipt of certified copy of this order.
