Learned counsel for the petitioners submits that the controversy involved in the present case has been settled by this Court in Writ Petition

No.2110/2010 (Ram Kumar Kapoor and others Vs. State of M.P. and others) decided on 15.03.2011, which was subsequently followed in the case o f Raghuveer Singh Jhala Vs. State of Madhya Pradesh and others Writ Petition No.19297/2018 decided on 05.03.2019.

Learned counsel for the State could not dispute the fact that the matter is identical to the order passed in Writ Petition No.2110/2010 (Ram Kumar Kapoor and others Vs. State of M.P. and others) and following the aforesaid judgment Writ Petition No.19297/2018 (Raghuveen Singh Jhala Vs. State of Madhya Pradesh and others) has already been disposed of vide order

05.03.2019.

I n such circumstances, the recovery orders are quashed. The petitioners are directed to file a representation along with the copy of this order to the respondents/authorities and the respondents /authorities are directed to consider and decide the representation and extend the benefits to the petitioner in the view of the law laid down in the case o f Ram Kumar Kapoor (supra) and Raghuveen Singh Jhala, (supra). The exercise be completed within a period of three months from the date of receipt of certified copy of this order.

With the aforesaid observations, this petition is disposed of.
