By this petition under Article 226 of the Constitution of India the petitioner seeks indulgence in the matter of correction of his parents' name written in the mark sheet of 10th standard in the year 2019 on the ground that

the name was inadvertently wrongly mentioned therein. However, Board has declined to make corrections relying upon clause 69.1 (i) & (ii) of the examination by-laws.

Learned counsel for respondent No.1 and 2 submits that the Hon'ble Supreme Court has quashed the aforesaid by-laws including Clause 69.1(i) &

(ii) and has taken pragmatic view in the matter of correction of date of birth and also change of name. Paragraph 171 and 172 of the judgment passed by the Hon'ble Supreme Court are relevant. He also submits that now the petitioner may apply afresh seeking such correction of parents' name in the

mark sheet and the same shall be dealt with in accordance with the directions of the Hon'ble Supreme Court.

In view of the aforesaid, this writ petition is disposed of with direction to the petitioner to apply afresh for correction of parents' name in the mark sheet of 10th standard issued on 06.05.2019.

The respondents/ Board shall consider the application in light of the direction contained Paragraph 171 and 172 of the Hon'ble Supreme Court in SLP No.3905/2011 (Jigya Yadav Vs. Central Board of Secondary Education) decided on 30.06.2021.

With the aforesaid, this writ petition stands disposed of.
