This is first application filed under Section 439 of Cr.P.C. for

The applicant has been arrested on 27.10.2021 in connection

with Crime No.891/2021 registered by Police Station Ambah, District

It is submitted by Counsel for the applicant that according to

the prosecution case, two persons who were going on a rickshaw

when they were stopped. The co-accused was driving the rickshaw,

whereas applicant was sitting in the rickshaw. 57.6 bulk liters of

country made liquor has been seized from the rickshaw/joint

The trial is likely to take sufficiently long time and there is no

possibility of his absconding or tampering with prosecution case.
