This criminal appeal has been filed under Section 374 of Cr.P.C.
against the judgment and sentence dated 6.5.2010 passed by Sessions Judge,
Bhind in Special Sessions Trial No.92/2007 by which the appellant Raju @
Ravindra Rajawat has been convicted under Section 302 of IPC.
It appears that one more appeal i.e. Criminal Appeal No.390/2010 has
also been filed by the appellant against the same judgment and sentence.
Since the Criminal Appeal No.390/2010 was filed prior in time, therefore,
the second Criminal Appeal No.573/2010 would not be maintainable.
Accordingly, it is dismissed as not maintainable.
However, Shri Ajit Singh Bhadoriya who is appearing on behalf of
appellant Raju @ Ravindra Rajawat is permitted to argue on behalf of
appellant in Criminal Appeal No.390/2010.
