Heard on I.A.No.15834/2021, first application under Section

397(1) of Cr.P.C. for suspension of jail sentence and grant of bail

filed on behalf of the applicant.

Learned counsel for the applicant submits that this criminal

revision assails the judgment dated 17.04.2018 passed in Criminal

Appeal No. 20/2018 by VI Additional Sessions Judge, Guna by

which the judgment dated 09.11.2017 passed in Criminal Case No.

153/2012 by J.M.F.C. Guna has been affirmed and the petitioner has

been convicted under Section 224 and sentenced to suffer two years

RI.

Learned counsel for the applicant submits that sentence of

the applicant has been suspended by the trial Court. The applicant

was on bail during trial and he has not misused the liberty granted to

him. Hence, he prays for suspension of sentence and grant of bail to

the applicant.

Learned Public Prosecutor for the State opposed the prayer

and prayed for dismissal of this application.

HIGH COURT OF MADHYA PRADESH CRR-2844-2018 (POTA @ GOVIND Vs THE STATE OF MADHYA PRADESH)

Considering the overall facts and circumstances of the case

and also the fact that the conviction is of 1 year, I.A.No.15834/2021

is allowed and it is directed that the jail sentence of the applicant will

remain under suspension, on the applicant's furnishing bail bond of

Rs.50,000/- (Rs.Fifty Thousand Only) with two solvent sureties

each of Rs.25,000/- to the satisfaction of the trial Court for his

appearance before the Registry of this Court on 17th September,

2021 and thereafter on such other dates as may directed by the

Registry of this Court in this regard.
