This is first application filed under section 439 Cr.P.C. Applicant Dev Singh was arrested on 03.02.2021 in Crime No. 47/2012 registered at Police Station Ashta, Tehsil Ashta, District- Sehore for the offence punishable under Sections 420, 467, 468, 469, 471 and 34 of IPC.

As per the prosecution case, on 23.01.2012 applicant impersonating himself as Chain Singh executed a sale deed of land bearing survey No. 102 area 2.27 acre owned by Chain Singh in favour of Shahid. Thus he committed fraud and prepared forged document.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in this case. Applicant at the instant of Anwar and Shahid executed the document (sale deed). The applicant has been in custody since 03.02.2021 and the conclusion of trial will take time, hence prayed for release of the applicant on bail.

Learned counsel for the State opposed the prayer and submitted that the alleged offence is said to have committed on 23.01.2012 while the police for the first time arrested the applicant on 03.02.2021. Trial court passed the judgment against the co-accused Sumit and Anwar and convicted them. So, the applicant should not be released on bail.

Looking to the facts and circumstances of the case, allegations and the contention of learned counsel for the State, this court is not inclined to grant bail to the applicant.

Hence, the M.Cr.C. is rejected.
