Heard on I.A.No.13008/2021, filed under Section 389 of Cr.P.C on behalf of the appellant Rambrij Jaiswal for suspension of substantive jail sentence.

Appellant has been convicted by the judgment dated 09.07.2021 passed by Second Additional Sessions Judge, Deosar, District-Singrauli (M.P.) in Sessions Trial No.99/2018. The Trial Court convicted the appellant for the offence under Section 323 of the Indian Penal Code and awarded sentence of six months R.I. with fine of Rs.1,000/-, under

Section 324 of the Indian Penal Code and awarded sentence of one year R.I. with fine of Rs.1,000/- and under Section 325 of the Indian Penal Code and awarded sentence of 2 years R.I. with fine of Rs.1,000/- with default stipulations.

It is stated in the application that the trial Court granted temporary suspension upto 09.08.2021. The appellant was on bail during trial.

Therefore, application (I.A.No.13008/2021) is allowed. It is ordered that if on or before 09.08.2021 appellant furnish a bail bond worth Rs.30,000/- (Rupees Thirty Thousand only) and a personal bond of the same amount to the satisfaction of the trial Court, the substantive jail sentence of the appellant Rambrij Jaiswal shall remain suspended and he shall be released on bail till final disposal of the appeal. After 2 CRA-4190-2021 releasing on bail, the appellant will appear before the Trial Court on 13.12.2021 and thereafter on other subsequent dates as may be fixed by the Trial Court.
