Although the matter was closed for orders on 02.07.2021, but, in the

course of preparing judgment, it was discovered that parties have not made any argument with regard to applicability of Section 12(5) of the Arbitration and Conciliation Act inserted by the Arbitration and Conciliation

(Amendment) Act, 2015 (Act No.3 of 2016) w.e.f. 23 rd October, 2015 and also whether any amendment has been carried out in Clause 2900 of IRS Conditions of Contract by Railways.

Counsel for the respondents prays for time to make submissions. Matter to come up on 13.08.2021.
