India.
The contention of learned counsel for the petitioners is that the
Tribunal by the impugned judgment dated 15.1.2020 (Annexure P-1) has
allowed the original application filed by the respondents relying on the
judgment of the Madras High Court in W.P. No.19024/2014 ( R. Chandrasekaran Vs. The Central Administrative Tribunal and others) and the judgment of coordinate Mumbai Bench of Tribunal in O.A. No.633/2015 (Prakash Vasant Ratnaparkhi and others Vs. The Union of India and others). It is submitted that these judgments have been set aside by the Supreme Court Civil Appeal No.2016/2020 (Union of India and others Vs. M.V. Mohanan Nair) (Annexure P-23) and other connected matters and the original application filed by the respective employees in those
cases have been set aside.
Issue notice to the respondents. Returnable within four weeks. In the meantime, the operation of the impugned judgment shall remain stayed.
