Shri Maqbool Khan, learned counsel for the appellant. He has moved an application, i.e. I.A. No. 4261/2021 mentioning therein that this appeal is arising out of judgment and decree dated 04.12.2002

passed in Civil Suit No. 1-A/2001 by learned Additional District Judge, Rewa. However, by the efforts made by common friends, parties have arrived at a settlement and as such, the matter has been settled between the parties, therefore, he does not want to pursue the appeal.

Accordingly, this appeal is dismissed as withdrawn in view of the terms of settlement arrived at between the parties.

The court fee paid by the appellant be refunded to him.
