Considered I.A.No.14717/2021, which is second application u/s 389(1) of Cr.P.C. for grant of suspension on behalf of appellant/applicant-Prakash who has been convicted by the impugned judgment dated 30.7.2018 passed

by the trial Court in Special Case No.08/2015 under sections 394 r/w 397 of IPC and u/s 11/13 of M.P. Dacoity Aam Vyapaharan Prabhavit Kshetra Adhiniyam and sentenced to undergo R.I. for 10 years and 7 years with fine of Rs.2,000/- and Rs.2,000/- respectively.

At the request of learned counsel for the appellant/applicant the State is directed to call for the report from the concerned Jail Authority regarding custody period served by the applicant. The State is also directed to call for the criminal record of the applicant, if any.
