After having heard learned counsel for the State in the present leave to appeal sought by the State in which the prosecutrix and as well as her mother both have not supported the prosecution story by denying the incident, the
only submission of learned counsel for the State which prima facie impress this Court is that vaginal swab of prosecutrix sent for being examined at Forensic Science Laboratory did not result in filing of FSL report. It seems that judgment of acquittal was rendered without awaiting the FSL report.
Accordingly, present MCrC for leave to appeal is allowed. Office is directed to register the present MCrC as Criminal Appeal.
Consequently, this MCrC stands disposed of.
