This is an application filed on behalf of proposed respondents seeking

recalling of the order passed on 19.12.2018 on the premise that aforesaid I.A. was dismissed for default of non-appearance of the appellant on 19.12.2018 whereas I.A. No. 7573/2016 was filed by the present proposed respondents under Order 1 Rule 10 CPC with prayer for arraying them as respondents.

It is submitted that the present appeal has been filed against the confirming judgment and decree dated 15.12.2007 passed in Civil Appeal No. 59A/2007 arising out of Civil Suit No. 30A/2007 decided on 29.09.2007. The Court below has dismissed the suit on the ground of non-joinder of necessary parties i.e. the proposed respondents.

Considering the facts and circumstances of the case, the order dated 19.12.2018 is hereby recalled.

Let I.A. No. 7573/2016 be placed for consideration afresh on the next date of hearing.

List the case after three weeks.
