No.3/State.

In the present matter, an application has been moved by the owner of

motorcycle (Honda Company) bearing Registration No. MP-33-MD-6204 seeking temporary custody of the same on the factual background that the said vehicle which was used in an offence of murder was directed to be released in favour of registered owner by judgment dated 27.09.2018 passed in SST No.52/2015 by the learned trial Judge while acquitting the respondent of the charge of murder, kidnapping, ransom alongwith other offences.

State Counsel Shri Shukla informs vide reply filed by State that said motorcycle while being in the custody of State was destroyed in an incident of fire.

Learned counsel for State as well as registered owner of the said motorcycle is directed to address on the issue that whether there is any enabling provision to resolve the situation of this nature.

List the case day after tomorrow i.e. 06.08.2021.
