Heard.

In this writ petition under Article 226 of the Constitution of India, the petitioners inter alia seek a direction to the respondents to regularize their

services in the light of judgment passed by the Apex Court in the case of Narendra Kumar Tiwari and others Vs. The State of Jharkhand and Others (Civil Appeal Nos.7423-7429 of 2018, arising out of S.L.P (Civil) Nos.19832-19838 of 2017) reported in (2018) 2 SCeJ 1288.

It is pointed out by learned counsel for the petitioners that juniors to the petitioners have been regularized namely one Deepak Upadhyay, who was appointed on 08.01.2000, whereas the petitioners were pointed on 24.07.1999, 06.01.2000 and 02.08.1998 respectively. It is prayed that in the light of aforesaid judgment, the petitioners' case be also considered for

regularization.

Learned Govt. Advocate for the State submits that the petitioners may be directed to file separate representation along with all the supporting documents and the authority concerned shall consider the same in accordance with law.

In view of the aforesaid submissions made by learned counsel for the parties, this petition is disposed of with a direction that in case, the petitioners submit fresh representation individually to the respondents/Competent Authority within a period of 15 days from the date of receipt of the certified copy of the order passed today, the respondents/Competent Authority shall consider and decide the same in the light of judgment passed by the Apex Court in the case of Narendra Kumar Tiwari and others Vs. The State Signature Not Verified SAN of Jharkhand and Others (supra) and also keeping in mind that juniors of Digitally signed by PANKAJ NAGLE Date: 2021.04.07 16:28:42 IST 2 WP-7889-2021 the petitioners have also been regularized.

Let this exercise be completed within a period of eight weeks from the date of filing of such representations by an speaking order.

It is made clear that this Court has not expressed any opinion on the merits of the case.
