JUDGMENT

The challenge in this appeal is against the
order dated 13.02.2025, of the Fee Regulatory
Committee for Medical Education in Kerala, fixing
the tuition fee and special fee in respect of the
1st respondent college for the MBBS Course, 2024-25.
2. Appellants 1 to 83 are students, and
appellant no.84 is the father of a student, of the
first year batch. The appeal is filed as provided
for under Section 11 of the Kerala Medical
Education (Regulation and Control of Admission to
Private Medical Educational Institutions) Act,
2017, challenging the fixation of fee.
3. We have heard the learned counsel on either
side.

4. Various grounds of challenge had been urged
against the order of the Regulatory Committee.
However for the reason noted hereunder, we find
that such contentions are not available to be urged
for the present proceedings.
5. As was noticed supra, the appellants are
students of the 2024-25 batch. The total number of
students for the batch is '200'. Fifty ('50') among
such students had approached this Court in WP(c)
No.12269 of 2025 challenging the very same order of
the Fee Regulatory Committee. This Court as per
judgment dated 27.03.2025, considered the
contentions on its merits and negatived the
challenge.
6. The judgment of this Court in WP(c) No.12269
of 2025 reveals that, though this Court had
observed about the scope of a writ proceeding,
proceeded to advert to the contentions of the
petitioners on the merits, including the factual

details. Finally it was concluded thus:
"9. The aforementioned chart reveals that the consumer price Index, additional
revenue expenses, over dependence on banks for loans and advances,
consequent debt-servicing expenditure and capital Investment to increase the
admission capacity to 200 seats are the factors which led to the precarious
situation of mounting deficits and therefore, while undertaking the exercise of
regulating the fees, due regard had been to the mandate of law on the subject as
per the provisions of Section 11(2) of the Act. Written Down Value of the
investment in building and the road used by the college had also been one of the
factors. All these factors if looked into cumulative, we are of the view that the
findings of fact and law arrived at by the Fee Regulatory Committee manned by
the expert committee is in consonance with the provisions of the Act referred to
above and cannot be said to be unfair, unpredictable and against the doctrine of
legitimate expectation as per the ratio deciendi culled out in the judgment cited
supra."
This Court, on the merits, upheld the order of the
Regulatory Committee.
7. It is seen that the review attempted in R.P
No. 938 of 2025 in WP(c) No.12269 of 2025, pointing
out the statutory appellate remedy was
unsuccessful. As per order dated 12.08.2025, review
petition was dismissed noticing that the writ
petition was dismissed after adjudication on the
merits of the contentions urged. The order reads
thus:

"Review petitioner had challenged the order of the Regulatory Commission.
We had uphold the order of the regulatory commission vide detailed order.
After that, had preferred an appeal against the order of the Regulatory
Commission. We are unable to fathom that how the appeal is entertainable,
once there is an adjudication against the order. If the remedy of appeal has to
be availed, liberty should have been asked for the withdrawal of the writ
petition, for filing the appeal. Petitioner cannot be permitted to approbate and
reprobate. No ground for interference is made out. Review petition is
dismissed."
8. Thus, the issue urged for consideration in
this appeal has already adjudicated upon in WP(c)
No.12269 of 2025 at the instance of one set of
students. The decision rendered therein would bind
the present appellants also, though not eo-nominee
parties. The writ petitioners were agitating the
same cause and essentially represented their
interests also. There is no contention that the
writ proceeding was not prosecuted bonafide. The
issue having already been adjudicated by this Court
in WP(c) No.12269 of 2025, we do not think it

permissible to have a re-adjudication in this
appeal. Such a course would essentially amount to
considering the correctness of the judgment passed
by the Division Bench in the writ petition.
In the light of the above, the appeal fails and
is dismissed.
