Heard Mr.M.R.Rajesh, learned counsel for the Appellant and Mr.P.Paulochan Antony, learned counsel for the Respondent No.1.
2. This is yet another petition filed under Article 226 of the Constitution of India, which seeks to question and seek relief in respect of proceedings initiated by the Bank under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act). Time and again the Hon'ble Supreme Court has cautioned against exercise of writ jurisdiction when there is a remedy available under the SARFAESI Act.
3. In the light thereof, the learned counsel for the Appellant states that he will approach the Debt Recovery Tribunal. Keeping all contentions of the parties open, we dispose of the appeal.
