                   JUDGMENT

The application filed by the petitioner for re-issuance of

lost passport has not been considered by the first respondent

stating that the petitioner did not produce the FIR.

2. Heard the learned counsel for the petitioner, the

learned Senior Panel Counsel as well as the learned

Government Pleader.

3. The law does not contemplate that along with an

application for re-issuance of passport, in case where the

passport has been lost, the applicant should produce the copy

of the FIR. The applicant had already submitted a complaint

online before the Station House Officer, Pathanamthitta

stating that he has lost his passport. Exts.P3 and P4 would

prove the same. Moreover, the applicant has made a

publication regarding the loss of passport in the news paper.

4. In these circumstances, I am of the view that there

can be a direction to the first respondent to consider Ext.P2

application without insisting for FIR.

In the result, this writ petition is disposed of with a

direction to the first respondent to consider Ext.P2 application

for re-issuance of passport without insisting for FIR and re-

issue passport within a period of one month from today, if the

application is otherwise in order.
