                                       JUDGMENT

This is an appeal challenging conviction and sentence of the

appellant. He was convicted for offences under Section 324 and

326 of the Indian Penal Code. He was sentenced to undergo simple

imprisonment for a period of three years and to pay a fine of

Rs.5,000/- for the offence under Section 326 and to undergo simple

imprisonment for a period of one year and to pay a fine of

Rs.5,000/- under Section 324 of the Indian Penal Code.

2. The learned Public Prosecutor placed on record a

report of the Station House Officer, Puthuppally Police Station

appended with a copy of the death certificate of the appellant. He

expired on 18.09.2015. Fine also forms part of the sentence, but

nobody has come forward to prosecute the appeal so far.

Therefore, the appeal in so far the sentence of imprisonment

is concerned stands abated and dismissed. Records are directed to

be consign in the record room since the appeal concerning the fine

part of the sentence survives.
