JUDGMENT
Petitioner has approached this Court seeking a direction to the
3rd respondent to dispose of Ext.P4 application within a time frame
fixed by this Court.
2. Petitioner is the absolute owner and title holder of 2.95 Ares of
land in Block No.1 in Survey No.256/5-9 of Rameswaram Village in
Ernakulam District. Petitioner submits that the property was dry land at
the time of commencement of the Kerala Conservation of Paddy and
Wetland Act, 2008 and is continuing even now, but the said land was
wrongly included in the data bank. Thereupon petitioner filed Form 5
application for correction in the data bank register before the 3 rd
respondent Revenue Divisional Officer and pursuant to a direction
issued by this Court Ext.P3 order has been issued whereby the
property was removed from the data bank. Now the petitioner has filed
Ext.P4 application to change the nature of the land and for permitting
her to utilize the land as dry land.
3. Heard the learned Government Pleader also.
After hearing both sides, I am inclined to dispose of the writ
petition with a direction to the 3 rd respondent to consider and pass
orders on Ext.P4 application as expeditiously as possible, at any rate
within a period of four months from the date of receipt of a copy of the
judgment.
Writ Petition is disposed of as above.
