affidavit filed therewith the High Court be pleased to stay all further
proceedings of the judgment and decree passed by the Sub Court, Nedumangad
in AS.93/2011 dated 27.02.2023 arising from the judgment and Decree dated
11.07.2011 in OS.NO.534/2008 on the file of the Principal Munsiff
Court,Nedumangad, till the disposal of the above Regular Second Appeal, in
the interest of justice.
     This Application coming on for orders upon perusing the application
and the affidavit filed in support thereof, and upon hearing the arguments

                                          ORDER

Admit on the following substantial questions of 1aw framed in the

second appeal memorandum.

(i) Is not Article 61 (b) of the limitation act applicable when the mortgagee transfers substantial portion of the mortgaged property?

(ii) When a transferee of the mortgaged property improves the property by constructing buildings thereon, is it proper to let off the value of improvements when the suit is adjudged?

Issue notice to the respondents by speed post returnable in two

weeks.
