     Writ petition (civil) praying inter alia that in the circumstances
stated in the affidavit filed along with the WP(C) the High Court be
pleased to direct the respondents 1 and 2 to release the Mini Tipper Lorry
bearing Registration No KL-48-P 2729 forthwith, pending disposal of the
writ petition.


     This petition coming on for orders upon perusing the petition and
the affidavit filed in support of WP(C) and upon hearing the arguments of
SHRI. MANOJ P.KUNJACHAN, Advocate for the petitioner, the court passed the

2. Learned Government Pleader takes notice for the

respondents.

3. The specific case of the petitioner is that even going

by the seizure mahazar, it is apparent that the vehicle was

seized in a public road and the same was an empty vehicle.

This Court has considered a similar matter in W.P.(C)

No.40240 of 2022 and issued Ext.P4 judgment dated

26.12.2022 directing release of the vehicle. Therefore, there

will be an interim direction to respondent Nos.1 and 2 to release

the Mini Tipper Lorry bearing registration No.KL-48/P-2729

forthwith.
