     Writ petition (civil) praying inter alia that in the circumstances
stated in the affidavit filed along with the WP(C) the High Court be
pleased to assess tax in respect of the petitioner's vehicles No.KL 70/B
8687 and KL 70/C 4647, without insisting floor area as specified in the
Kerala Finance Bill 2016 and levy tax in accordance with the seating
capacity, pending disposal of the Writ Petition (Civil).


     This petition coming on for admission upon perusing the petition and
the affidavit filed in support of WP(C) and upon hearing the arguments of
SRI. O.D.SIVADAS, Advocate for the petitioner and of GOVERNMENT PLEADER
for the Respondents, the court passed the following:

                                            ORDER

Admit.

The learned Government Pleader takes notice for the

respondent.

Having regard to the averments in the writ petition and

taking note of Ext.P3 judgment, there will be an interim order

directing the respondent to assess tax in respect of vehicles

bearing registration Nos.KL-70/B 8687 and KL-70/C 4647 in

accordance with the seating capacity. This shall, however, be

provisional and subject to final orders to be passed in the writ

petition.
