                    AMIT RAWAL, J
                  -----------------------
          Cont. Case (C) No. 1876 of 2021
                   ----------------------
Dated this the 24th day of February, 2022

                            ORDER

This Court in respect of a Writ Petition of 2010 vide

judgment dated 14.07.2021 had, after considering the

rival contentions of the parties, directed the State to

release the salary of the petitioner with effect from

01.06.2005 to 2012 within a period of two months from

the date of receipt of a certified copy of the judgment,

failing which it will inure interest at the rate of 10% per

annum.

2. Adv.Gouri Balagopal submits that the State

preferred Writ Appeal bearing No.1614/2021, in the

initial hearing there was an interim order but now it has

been dismissed vide judgment dated 21.12.2021 and

petitioner is left high and dry as is deprived of the salary

for the aforesaid period.

3. Mr.Jimmy George representing the State

submits that even a Reveiw Petition is being filed and

likely to come up for hearing on 02.03.2022. This is not COC No. 1876 of 2021

an excuse for granting the adjournment. Already there

is a caveat of imposition of 10% interest which I deem it

appropriate to impose upon the person for not

implementing the order, along with the costs of another

Rs.50,000/- (Rupees fifty thousand only) and with a

direction to appear in person on 28.02.2022 as to why he

should not be sentenced for commission of the wilful

contempt.

4. In case the order is complied with before the

date of appearance, not only the appearance shall be

exempted, even the imposition of costs would not be

implemented.
