                           ORDER

For information purpose only This appeal is against the order of the Court below

whereby a prayer for return of MO2, which is cash of

Rs.25,000/-, was rejected finding that there is no proof to show

that the said amount belongs to PW1 who is the appellant. MO1

which was gold ingots, have been ordered to be returned to the

appellant. It is seen from the judgment of the court below in

SC.No.103/2004 that accused Nos. 4 and 5 were absconding

and the case was proceeded only against accused Nos. 1 and 3.

The Public Prosecutor shall take instructions regarding the

stage of enquiry as against accused Nos.4 and 5.

Registry is directed to get a report from the Court below

regarding the further proceedings that had been initiated

against accused Nos.4 and 5 in this case and whether they have

already faced trial for the offence.
