JUDGMENT
Ext.P5 is an application preferred by the petitioner
for grant of licence in terms of the Kerala Panchayat Raj
(Issue of Licence to Factories, Trades, Entrepreneurship
Activities and Other Services) Rules, 1996. The grievance of
the petitioner in the writ petition concerns the inaction on the
part of the second respondent in considering and passing
orders on Ext.P5 application. The petitioner, therefore, seeks
appropriate directions in this regard in the writ petition.
2. Heard the learned counsel for the petitioner.
3. In the nature of the order I propose to pass in
this writ petition, no notice need be issued to the
respondents.
Having regard to the facts and circumstances of
the case, I deem it appropriate to dispose of the writ petition
directing the second respondent to consider and pass orders
on Ext.P5 application, in the light of the decision of this Court
in Tomy Thomas v. State of Kerala & Others, 2019 (4)
KHC 553(FB). Ordered accordingly. This shall be done within
two weeks, with notice to the petitioner.
