                                JUDGMENT

Dated this the 22nd day of January 2021

An application for regular permit on an inter district route was

submitted by the petitioner. It was taken up on 05.03.2020 in the RTA

meeting and adjourned for prior concurrence of the sister RTA. The

grievance of the petitioner herein is that thereafter Ext.P1 application

has not been taken up and considered.

2. When the matter was taken up, the learned senior Government

Pleader submitted that the report of the concerned MVI has been

called for and is awaited. It was submitted that on receipt of it, the

matter shall be placed before the next meeting of RTA. The entire

process shall be completed and order passed on Ext.P1 as

expeditiously as possible, at any rate, within a period of six weeks

from the date of receipt of a copy of this judgment, after giving

reasonable opportunity to all concerned.

3. The learned Senior Government Pleader submitted that,

there may not be direction for taking decision invoking Rule 130 of

the Kerala Motor Vehicles Rules. This was answered by the learned

counsel for the petitioner contenting that, this matter was taken up in

the earlier RTA meeting, there was no objectors and by virtue of the

STAT order, matter is awaiting the concurrency alone. WP(C).No.991 OF 2021

Having regard to this, I am inclined to direct that, in the light of

what is mentioned by the petitioner, in case the RTA meeting could

not be convened due to any reasons beyond the control of the RTA,

the decision shall be taken in accordance with law, by invoking Rule

130 of the Kerala Motor Vehicles Rules.
