JUDGMENT
Heard the learned counsel for the petitioners and Sri.M.K.Chandra
Mohandas, the learned Standing Counsel appearing for the 2nd
respondent.
2. The contention of the petitioners in the writ petition is that the
petitioners are entitled to count previous military service for the
grant of higher grade under the 1 st respondent. Seeking the above
benefits, petitioners have preferred Exts.P11 and P12 representations
before the 2nd respondent. It is submitted that Ext.P5 is a judgment of
the Apex Court which grants the benefit to similarly situated persons.
3. Having considered the contentions advanced, I am of the opinion
that it is for the 2nd respondent to take an appropriate decision in the
matter. There will, accordingly, be a direction to the 2 nd respondent to
take up, consider and pass orders on Exts.P11 and P12 representations
preferred by the petitioners. The applicability of Ext.P5 judgment shall
also be considered by the 2nd respondent while passing orders as
directed above. Orders shall be passed within a period of two months WP(C).No.28069 OF 2020
from the date of receipt of a copy of this judgment.
This writ petition is ordered accordingly.
