JUDGMENT

1. The writ petition is filed with the following prayers:-

"i. To issue Writ of mandamus or order or any other direction directing the respondents to report the vacancies of class IV employees and to fill up the existing vacancies of class IV employees from Ext P2 rank list published by the 1 st respondent university.

ii.To issue Writ of mandamus or order or any other direction directing the respondents to fill up the vacancies which are arising during the currency of Ext P2 rank list from Ext P2 rank list. iii.To issue Writ of mandamus or order or any other direction directing the respondents to appoint the petitioners as class IV employees of the respondents 1, 4 and 7 universities. iv.To issue Writ of mandamus or order or any other direction directing the respondent universities to fill up the vacancies of Class IV employees which may arise consequent to the promotion, retirement, death etc. of the existing class IV employees, from Ext P2 rank list. "

2. Heard the learned counsel for the petitioners and learned

standing counsel appearing for the respondents. W.P.(C).No.27737/2019

3. The learned counsel for the petitioners submits that they had

applied for the post of Class IV employees in the 1 st

respondent University pursuant to a notification dated

9.6.2009. The selection process was unduly delayed and a

ranked list was published on 6.10.2018. It is stated that in the

meanwhile the 4th respondent was bifurcated from the 1 st

respondent University on 1.5.2011 and the 7 th respondent was

bifurcated from the 1st respondent University on 1.4.2011. It is

stated that since the institutions available under the 1 st

respondent were also part of the bifurcation process, the list

prepared by the 1st respondent is liable to be operated in the

4th respondent and 7th respondent universities as well. It is

stated that there were no appointments made to the posts of

Class IV employees in the respondent Universities and

therefore the list prepared is liable to be operated in the other

universities as well. It is submitted that since the total cadre

strength of Class IV employee is 271, there are 136 posts to be

filled up by direct recruitment and the University has made

appointments only against 91 posts. It is stated that the

vacancies which arose between 2009 and 2018 had not been W.P.(C).No.27737/2019

taken into account and the petitioners are, therefore, eligible

for appointment from the list.

4. Counter affidavits have been placed on record by the

respondents. Respondents 4 to 6 submit that Exhibit P2 is a

ranked list for Class IV employees in the Kerala Agricultural

University and the same is evidently not applicable to the 4 th

respondent. It is stated that all non-teaching posts in the 4 th

respondent University are to be filled up through the Public

Service Commission, as is specifically provided in the First

Statutes. It is contended by the learned counsel appearing for

respondents 7 to 9 also that since the list is prepared for filling

up vacancies in the 1st respondent University and since Section

50 of the Kerala University of Fisheries and Ocean Studies Act,

2010 and Clause 9 of the First Statutes provide that direct

recruitment to all non-teaching posts are to be made through the

Public Service Commission, no steps can be taken for

appointment from Exhibit P1 ranked list which has admittedly

been prepared by the Agricultural University in 2018. W.P.(C).No.27737/2019

5. Having considered the contentions advanced, I find that the

contention of the petitioners that appointments are to be made in

the 4th and 7th respondent Universities from Exhibit P2 list is

completely unsustainable. In the admitted factual situation, the

list prepared in 2018 long after the bifurcation cannot be

operated to fill up vacancies in 4th respondent and 7th respondent

Universities.

The writ petition, therefore, fails and the same is accordingly

dismissed.
