Application praying that in the circumstances stated in the affidavit filed therewith the
High Court be pleased to issue an interim order of injunction restraining the Respondents
herein and others claiming under them from claiming the compensation pursuant to the
acquisition proceedings initiated in respect of the property scheduled to the plaint in
OS.No.107 of 1977 on the file of the Munsiff's Court, Tirur, pending disposal of the above
Regular Second Appeal.
This application coming on for orders upon perusing the application and the affidavit

ORDER
Heard the learned counsel for the appellants and
the respondents.
2. This is an application to issue an interim order
of injunction restraining the respondents and others
claiming under them from claiming the compensation
pursuant to the acquisition proceedings initiated in
respect of the property scheduled to the plaint in
O.S.No.107/1977 on the file of the Munsiff Court, Tirur,
pending disposal of the appeal.
3. The learned counsel for the respondents seeks
time to file objection.
4. The Trial Court granted a decree in favour of
the plaintiffs restraining the defendants 2,3 and 5 to 15
and their men and agents from trespassing into the
disputed portion of the property. The matter was carried

in appeal. The first Appellate Court dismissed the appeal

allowing the cross objection filed by the plaintiffs.
Challenging the judgments of the two courts below,
defendants 1, 6 to 10 and 15 have filed this appeal.
5. The allegation is that a portion of the suit
property (around 80 cents in survey No.248/2B in
Kuttipuram Village) is proposed to be acquired for
widening the National Highway No.66 (old National
Highway No.17) (between the stretch from Kutippuram to
Valancherry). The petitioners/plaintiffs apprehend that
on the strength of the order of stay granted in this
appeal, the respondents are attempting to claim the
compensation amount.
6. Considering the urgency involved and also in
view of the ensuing summer vacation, it is just and proper
to direct the respondents not to claim compensation
pursuant to the acquisition proceedings initiated in
respect of the property.
Resultantly, the respondents are restrained from

claiming compensation pursuant to the acquisition

proceedings initiated in respect of the property scheduled
to the plaint in O.S.No.107/1997 on the file of the Munsiff
