The petitioner is before this court calling in question
registration of a crime in Crime No.120 of 2024 registered for
offences punishable under Sections 409 and 420 of the IPC and
pending before the Principal Civil Judge & JMFC, Karkala, Udupi
District.
2. Heard Sri M Aruna Shyam, learned senior counsel
appearing for the petitioner, Sri B N Jagadeesha, learned Additional
State Public Prosecutor for respondent No.1, Sri V K Srikanth,
learned counsel appearing for respondent No.2 and Sri Dinesh
Hegde Ulepady, learned counsel appearing for respondent No.3.
3. The facts, in brief, germane are as follows:-
The facts in the case would begin from 23-08-2022, the date
on which Government issues exemption to Udupi Nirmithi Kendra
under Section 4(g) of the Karnataka Transparency in Public
Procurements Act, 1999 ('the Act' for short). Pursuant to the
exemption so granted, without notifying the tender, the petitioner
was issued with a work order by Udupi Nirmithi Kendra to sculpt a
Parashurama statue made out of bronze metal. The petitioner
sculpted the statue, made it ready and was installed or erected on
the intended site, as per the work order at the Theme Park, which
consisted of film studio, open theater and photo gallery. All these
were inaugurated on 27-01-2023. However, the work of the statue
was not complete. The petitioner submits a representation, after
about 8 months of inauguration, to permit him to complete the
balance work on the statue.
4. The Project Director of Udupi Nirmithi Kendra places a note
along with the representation of the petitioner, to the Deputy
Commissioner. The Deputy Commissioner considering the
representation, permitted the petitioner to undertake re-work of the
alleged faulty alignment of Parashurama statue. Accordingly, Udupi
Nirmithi Kendra permits/grants the petitioner two months time to
do the needful to bring in the alignment of the statue scientifically.
Pursuant to the order of the Deputy Commissioner, the Tahsildar is
said to have issued a press note notifying that realignment work of
the statue is in progress and that tourists are restricted from
entering the theme park.
5. When things stood thus, on 21-12-2023 a show cause
notice comes to be issued against the petitioner by the Udupi
Nirmithi Kendra for non-completion of the work within the time
stipulated i.e., two months as was directed on 07-10-2023. The
petitioner replied to the same on 09-01-2024 and seeks extension
of time. The metal that was used by the petitioner for sculpting the
statue become a subject matter of suspicion, as it was not bronze.
It was sent for examination to National Institute of Technology
Karnataka ('NITK'), Surathkal. The NITK submits a report that the
statue consisted of 80% copper and 20% zinc. Based upon the said
report, the petitioner files writ petition in Writ Petition No.11690 of
2024 before this Court seeking a direction to Udupi Nirmithi Kendra
to permit him to continue the work. The writ petition comes to be
disposed of on a memo filed by Udupi Nirmithi Kendra that the
petitioner can complete the work on certain conditions. Udupi
Nirmithi Kendra then issues an Official Memorandum permitting the
petitioner to carry out the work.
6. The very next day, the State passes an order directing the
CID to investigate into the allegations against the petitioner. The
petitioner challenges the said action of the CID being directed, in
Writ Petition No.14457 of 2024. A coordinate Bench of this Court
has stayed further proceedings thereto. After the stay being
granted, a complaint comes to be registered by the 2nd respondent
which becomes a crime in Crime No.120 of 2024 for the aforesaid
offence. This Court, owing to the fact that the Deputy
Commissioner permitted realignment work of the statue from the
hands of the petitioner, granted protective order against the
petitioner in the subject crime. Therefore, the acts of the petitioner
were neither investigated by the CID nor by the jurisdictional
police.
7. The learned senior counsel Sri M Aruna Shyam appearing
for petitioner would vehemently submit that usage of material is not
in question. The shoddy work of the statue is not the allegation.
The allegation is that the petitioner has committed GST fraud and
the statue is de-erected for the reason that the alignment of the
statue was not scientifically done. Even now, if the petitioner is
permitted to complete the work he will complete the work of
sculpting scientifically and get the statue re-erected. The offences
under Sections 409 and 420 of the IPC cannot be laid against the
petitioner is his emphatic submission.
8. Per contra, the learned counsel appearing for the 2nd
respondent/complainant would submit that the work order was
issued for sculpting the statute in bronze. The report of NITK says
that what is used is copper and zinc. Therefore, the petitioner is
guilty of using poor quality material. The complainant would
emphasize the fact that even before the beginning of the work
`1.20 crores was transferred to the petitioner claiming to be an
advance, as he has claimed `1.83 crores as his sculpting fee. He
would contend that it is a matter of investigation as to how even
before entrustment of work an amount of `1.20 crores was made
over to the petitioner. It is an admitted fact, if not referring to the
material used, the way sculpting is done. The theme park was
inaugurated for the purpose of inauguration. The statue itself was
wrongly erected. It is brought down in the month of January 2023
and even to-day the petitioner has not completed the work. It is a
clear case where Udupi Nirmithi Kendra and the petitioner are hand
in glove. Therefore, he would submit that it is a matter of
investigation.
9. The learned Additional State Public Prosecutor would also
toe the lines of the learned counsel for the complainant and submit
that matter has to be investigated into, as the petitioner is alleged
of usage of substandard material. He would also seek dismissal of
the petition.
10. I have given my anxious consideration to the submissions
made by the respective learned counsel and have perused the
material on record.
11. The afore-narrated facts are not in dispute. Section 4(g)
exemption under the Act is granted in favour of Udupi Nirmithi
Kendra. Udupi Nirmithi Kendra then issues a work order to the
petitioner on 15-12-2022. The said order reads as follows:-

The quotation and the work order would depict one fact that the
petitioner was issued a work order for making a sculpture of
Parashurama in bronze metal and all inclusive quotation was for
Rs.1.83 crores. The work order so issued contained few clauses
which are necessary to be noticed; they are escalation, passing of
works and arbitration. The said clauses read as follows:
"Escalation:
The rate approved is valid for the entire period of construction
agreed upon. No escalation will be given on any account.
Rates:
The bill shall be raised on the basis of approved rate. Any extra
items, which are not listed in the BOQ, shall be paid as per the
standard rate analysis and approved by Udupi Nirmithi Kendra.
The decision of the Udupi Nirmithi Kendra, in this connection is
final and binding.
Passing of works:
All works executed by the contractor will be to the entire
satisfaction of Engineer in charge. Any work rejected by
the engineer in charge will be dismantled / demolished
and redone by the contractor at his own cost for which no
compensation will be paid. All works executed will be
required to be passed by the Engineer in charge.
Arbitration:
Any dispute which may arise during currency of contract
is to be settled mutually. The decision of Udupi Nirmithi
Kendra will be final & binding on the contractor.
Copy of work order may please be signed and returned to
this office along with one copy of terms and conditions
duly signed.

This work order was issued to the petitioner, as observed
hereinabove, on 15-12-2022. The statue was ready within 45 days.
It was erected in the theme park which was established by the
Udupi Nirmithi Kendra. It was inaugurated and made open to
public. It is then found that the alignment of the statue is
erroneous. The petitioner himself, when allegations cropped up,
that it was done incorrectly, gives a representation. The
representation reads as follows:

He admits that the statue was prepared hurriedly for the purpose of
inauguration of the theme park. The alignment is wrong and he
has been given only `1,25,50,000/- and the remaining amount of
`79,46,000/- was also sought in the said representation. This is
given to the Project Director of Udupi Nirmithi Kendra. The Udupi
Nirmithi Kendra, in reply to the representation of the petitioner,
permits de-erection and re-working of the statue. The reply dated
07-10-2023 reads as follows:

work from 07-10-2023. It was not completed. The petitioner
comes before this Court seeking a mandamus to complete the
work. A memo is filed by the Udupi Nirmithi Kendra that it will pass
necessary orders on the representation given for completion of the
work. This Court recording the submission disposed of the writ

Eighty -Three lakhs Only), excluding GST and other charges
payable to the concerned department as per the agreement,
The total, including GST and other charges is payable at
Rs.2,04,96,000.00 (Rupees Two Crores Forty Nine Lakhs Six
Thousand Only)
c) The Petitioner shall cooperate with the Respondent for technical
verification before handing over the statue.

from the date of the order of this honorable court and shall
execute the undertaking in that respect.

The complaint then becomes a crime in crime No.120 of 2024 for
offences punishable under Sections 409 and 420 of the IPC.
12. The issue in the lis would be, whether the material
used by the petitioner for making the statue could not have
been used, as what was ordered was using of bronze and
what is used is copper and zinc?
13. The NITK has confirmed the presence of copper and zinc
in the statue erected by the petitioner. No fault can be found with
the material used for the reason that, bronze is not an independent
material. It is an alloy. An alloy, is known, an amalgam of
independent metals. Therefore, bronze to become an alloy, it can
contain copper, zinc, tin and several other independent materials.
The maximum component of any bronze alloy is copper is in
scientific domain. The maximum independent metal in the case at
hand, is also copper. The material used may not fall for
investigation as NITK, a premier institute has also confirmed its
presence, but that would not absolve the petitioner of any
investigation, as a shoddy statue was sculpted in a hurried manner.
The sculpture did not have the strength to stand, as the alignment
was completely erroneous. Though the petitioner was entrusted
with the work of sculpting the statue scientifically according to the
specification and within the time frame for erection in the theme
park before the inauguration day, he has done a shoddy job, prima
facie.
14. The admitted fact is that the statue had to be de-erected
or taken down 8 months later, due to mushrooming of complaints
of shoddy work. The petitioner had admittedly taken `1.25 crores.
If `1.25 crores is taken and statue is not in a withstandable
condition, it is ununderstandable as to what sculpting the petitioner
did. After de-erection of the statue, the petitioner is still wanting to
work on the statue to bring it into proper form/alignment, after
about 12 months of de-erection. The work is not complete. It is
fortunate that the statue did not fall, after its inauguration,
threatening the lives of common people. What is paid to the
petitioner is neither the proposal funds of Udupi Nirmithi
Kendra nor the money of the complainant. It is public
money. Public money of `1.80 crores is sought and `1.25 crores is
paid, all for a erroneously aligned statue sculpted by the petitioner.
It was hurriedly done for the purpose of theme park and the
petitioner is wanting to set it right for the last 12 months, which
would not mean that the petitioner could get absolved of the
investigation even, in the case at hand.
15. The offence is one of cheating, the ingredients of which
are found in Section 415 of the IPC. The circumstance of accused
luring the victim with a dishonest intention would not simply
become applicable to the case at hand and lead to quashment of
proceedings. The petitioner, when entrusted with a job, has taken
public money of `1.25 crores, which is not a pittance. Therefore, it
needs investigation in the least, as to why the petitioner has done a
shoddy job, notwithstanding huge sums of money being
transferred. The shoddy job is still being redone. This would
clearly demonstrate that what was erected was only an eye-wash,
at least qua alignment. In that light, I do not find any warrant to
interfere with the investigation in the impugned crime.
16. The learned senior counsel has relied on the judgment of
this Court in the case of AMIT GARG v. STATE OF KARATAKA -
Criminal Petition No.4856 of 2021 decided on 26-07-2022.
There can be no qualm about the principles laid down therein, as
this Court was following the judgment of the Apex Court in the case
of SUSHIL SETHI v. STAE OF ARUNACHAL PRADESH - (2020)
3 SCC 240. The facts that are obtaining in the present case are
different from what was obtaining before the Apex Court or in the
order of this Court. They need investigation and investigation in the
least should be permitted to be continued.
17. In the result, finding no merit in the petition, the petition
stands rejected, leaving open all remedies to the petitioner.
Interim order of any kind operating shall stand dissolved.
Consequently, I.A.No.3 of 2024 also stands disposed.
