HON'BLE I ADD.PRL.JUDGE FAMILY COURT, VIJAYAPURA &
DISMISS THE MAINTENANCE PETITIION FILED BY THE
RESPONDENTS IN THE INTEREST OF JUSTICE
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
THE COURT MADE THE FOLLOWING:
ORDER
In this petition, the petitioner has challenging the
order dated 11.07.2018 passed in Crl.Misc.No.320 by
the I Additional Principal Judge, Family Court
Vijayapura, granting maintenance to the respondents.
2. Heard the learned counsel appearing for the
parties.
3. Having take note of the submission made by
the learned counsel appearing for the petitioner, there
is no dispute with regard to relationship between the
parties. Perusal of the finding recorded by the Family

Court would indicate that, the respondent No.2 has
initiated proceedings under the provisions of Domestic
Violence Act. In that view of the matter, taking into
account that the respondents herein are residing
separately from the petitioner herein, as the
respondents have stated that the petitioner is herein
is having immovable property to an extent of 10
acres, and growing grapes and sugarcane, however,
the petitioner herein has not proved the said fact by
adducing evidence, and in that view of the matter,
award of maintenance of Rs.3,000/- granted by the
Family Court is just and proper and does not call for
interference. Accordingly, the revision petition is
dismissed.
