COMMON ORDER
In all these writ petitions, common subject matter is July-
August, 2023 MBBS Examinations in respect of RS-3 batch
students. Hence, they are taken up together for disposal.
Prayers sought in W.P.nos.29338/2023, 1101/2024,
1102/2024, 1119/2024, 1121/2024, 1186/2024, 1208/2024,
1202/2024, 1213/2024 and W.P.no.1222/2024, are as follows:
"a) Issue a writ of order or direction in the nature of certiorari quashing the impugned 'Amendment to Ordinance / Notification Governing Central Assessment Programme (CAP) for Theory Paper Assessment of all Under Graduate Health Science Courses of University' dated 13.06.2023 with No.RGU/AUTH/25th Con/Syn/16/2023-24 issued by the respondent no.2 vide Annexure-L; and
b) Issue a writ or order or direction in the nature of mandamus directing the respondent university to re-compute the results of the MBBS (RS3) Examinations of July-August 2023 undertaken by the petitioner by considering only the highest marks from amongst the valuation marks already awarded to the petitioner for the failed subjects of the MBBS (RS3) Examinations of July-August 2023 and to declare the results afresh; and/or
c) In the alternative, issue a writ or order or direction in the nature of mandamus directing the respondent university to recomputed the results of the MBBS (RS3) Examinations of July-August 2023 undertaken by the petitioner by considering the average of the highest two marks awarded from amongst the valuation marks already awarded to the petitioner by considering the average of the highest two marks awarded from amongst the valuation marks already awarded to the petitioner for the failed subjects of the MBBS (RS3) Examinations of July-August 2023 and to declare the results afresh; to be in compliance of the decisions rendered by this Hon'ble Court in Neelesh Mehta's case and Basanth K.B.'s case

by conducting 4/5 valuations only with respect to the failed subjects; and/or
d) In the alternative, issue a writ or order or direction in the nature of mandamus directing the respondent university to apply the 'Amendment to Ordinance/Notification Governing Central Assessment Programme (CAP) for Theory Paper Assessment of all Under Graduate Health Science Courses of University' dated 05.09.2022 with no.RGU/AUTH/24th Con/Synd/04/2022-23 issued by the respondent no.2 vide Annexure-K to the MBBS (RS3) Examinations of July-August 2023 undertaken by the petitioner and thereafter to conduct 2/3 additional valuations (4/5 valuations) of the failed subjects of the MBBS (RS3) Examinations of July-August 2023 and to declare the results afresh; strictly in terms of the decisions rendered by this Hon'ble Court in Neelesh Mehta's case and Basanth K.B.'s case; etc.
2. In W.P.no.19983/2023, following reliefs are sought:
"a) Issue a Writ of Mandamus or any other appropriate Writ, Order or Direction to Respondent no.1-University to re-compute and declare fresh results of he subjects in which the petitioners have been declared to be unsuccessful in MBBS (RS3) Examinations of July/August 2023 by taking the highest marks awarded by all the evaluators in a time bound manner;
OR
b) Issue a Writ of Mandamus or any other appropriate Writ, Order or Direction to Respondent No.1 University to re-compute and declare fresh results of the subjects in which the Petitioners have been declared to be unsuccessful in MBBS (RS3) Examinations of July/August 2023 by taking the highest marks awarded by the first two evaluators in a time bond manner;
3. Sri Abhishek Malipatil, and Sri Nishant A.V. learned
counsel for petitioners submitted that petitioners were admitted
to MBBS Course in respective institutions during academic year
2018-19 or prior academic years and were governed under

Revised Scheme-3 ('RS-3' for short) issued by Respondent
no.1. It was submitted that on 29.03.2019, respondent no.2
('RGUHS' for short), notified 'Ordinance Governing Under
Graduate Valuations' ('2019-Ordinance' for short) governing
manner of evaluation of answer scripts of all Under-Graduate
Courses including MBBS. It was submitted that valuations of
MBBS Theory Answer Scripts were to be by two evaluators with
provision for re-valuation in case of difference between two
evaluations being more than 15% of total marks of subject.
4. It was submitted that 2019-Ordinance was quashed
in entirety by this Court in Neelesh Mehta and Ors. Vs.
RGUHS and Another1 and direction was issued to RGUHS to
cause valuation of all theory answer scripts of petitioners by set
of four evaluators as per Regulation 13(2) of Graduate Medical
Education Regulations, 1997, ('MCI Regulations' for short)
framed by Medical Council of India (which is presently
reconstituted as National Medical Commission.
5. It was submitted that on 13.10.2020, RGUHS
promulgated Amendment to Ordinance Governing Valuation of
W.P.no.31335/2019 c/m D.D.10.08.2020.

Answer Scripts of MBBS Course (RS-3 Scheme), ('2020-
Ordinance' for short) mandating evaluation by four valuators
and computation of results by averaging marks awarded by
four evaluators, allegedly to bring it in conformity with MCI
Regulations. But 2020-Ordinance was also quashed by this
Court in Basant K.B. Vs. RGUHS & Another2 and directions
were issued for conducting additional valuation 'only in respect
of failed subjects' following ratio in Dr.Menaka Mohan &
Others Vs. Registrar (Evaluation) RGUHS & Others 3.
6. Thereafter, on 01.02.2021, RGUHS issued
notification and promulgated Ordinance Governing Central
Assessment Program (CAP) for Theory Paper Assessment of
MBBS Course ('CAP-2021' for short), providing for evaluation
by two evaluators and computation of results by taking average
of marks awarded by two evaluators, with provision for
deviation valuation is difference between two evaluations were
more than 15 of total marks of that subject. It was submitted
that RGUHS announced results of Exams applying above
regulation, without following 2 + 1 valuation scheme. Hence,

CAP-2021 was questioned in Nireeksha S. Vs.
RGUHS & Others4 before this Court. Same was allowed on
01.07.2021, directing RGUHS to conduct two additional
valuations 'in respect of failed subjects' by following ratio in
Dr.Menaka Mohan's case (supra). It was submitted that
W.A.no.771/2021 filed against it was dismissed on 12.08.2021.
7. It was submitted that this Court while passing order
in Jordan Ridhay Rasquinha & Others Vs. RGUHS &
Others5 in had held that conduct of two valuations of answer
papers of 'passed students/subjects' as against conduct of 4+1
valuation of answer papers of 'failed students/subjects' in terms
of Regulation 13(2) of MCI Regulations would not amount to
discrimination, but as giving added benefit to failed candidates.
8. Thereafter on 05.09.2022, RGUHS promulgated
Ordinance/Notification Governing Central Assessment Program
(CAP) for Theory Paper Assessment of MBBS Course ('CAP-
2022' for short) with effect from 01.09.2022, providing for
evaluation of Theory Answer Scripts by two evaluators and

declaration of results by taking highest marks from amongst
evaluators.
9. It was submitted that CAP-2022 came to be
challenged by several students in Mr. Ricardo Konjengbam &
Others Vs. RGUHS & Others6. In said petition, on
19.04.2023, RGUHS filed affidavit accepting contentions of
students and agreeing for conducting two additional valuations
in terms of judgement passed in Neelesh Mehtaand Basant
K.B. cases (supra) followed in Thejaswi Ketham & Others
Vs. RGUHS & Another7. It was submitted that contrary to said
decisions, RGUHS sought to conduct two additional valuations
for 'passed as well as failed students/subjects'. Taking note of
same, an interim order was granted on 19.04.2023 directing
RGUHS to conduct two additional valuations in failed subjects
providing for revaluation in case of difference of marks between
two evaluators were more than 15% and announce results
within three weeks.
10. It was submitted RGUHS did not comply with interim
order in letter and spirit but issued Circular dated 04.05.2023

providing only for two additional valuation of failed subjects of
petitioners and other RS-3 students. Thereafter, RGUHS issued
amended Ordinance/Notification Governing Central Assessment
Program (CAP) for Theory Paper Assessment of MBBS Course
('Amended CAP-2022' for short) excluding RS-3 students from
scope of CAP-2022, after it had issued Circular to comply with
interim order dated 19.04.2023 in Ricardo Konjengbam's
case (supra). Therefore, validity of Amended CAP-2022 was
called in question in this writ petition.
11. It was submitted that petitioners have appeared for
MBBS (RS3) Examinations, July 2023.
12. It was submitted that Amended CAP-2022 was
issued ignoring pertinent directions issued by this Court in
Neelesh Mehta; Basanth K.B.; Nireeksha; Jordan Ridhay
Rasquinha; Thejaswi Ketham and Ricardo Konjengbams's
cases (supra). It was pointed out that this Court had not issued
any directions to University to apply Regulation 13(2) of MCI
Regulations, 1997, to all subjects, but direction issued were
confined only to failed subjects and after hearing RGUHS as
well as NMC. Therefore, there was no occasion for issuance of

Amended CAP-2022, contrary to judgements and directions in
their true spirit, especially, when CAP-2022 was not set aside
by this Court.
13. It was submitted that while issuing Amended CAP-
2022, RGUHS cannot be permitted to profess that same was
issued in compliance with directions issued in Neelesh Mehta;
Basanth K.B.; Nireeksha; Jordan Ridhay Rasquinha;
Thejaswi Ketham and Ricardo Konjengbam cases (supra).
14. It was submitted that issuance of Amended CAP-
2022 and applying it retrospectively from 01.09.2022 was
illegal and arbitrary, especially when there was no power
vested in RGUHS under Rajiv Gandhi University of Health
Sciences Act, 1995 ('RGUHS Act' for short) to promulgate
ordinances retrospectively. Hence, Amended CAP-2022 was
liable to be quashed on ground of being issued beyond scope of
powers of RGUHS.
15. It was submitted that NMC was party in above
matters and therefore estopped from opposing present writ
petitions without having challenged said directions/orders. It

was further submitted that sustaining Amended CAP-2022
would amount to permitting RGUHS to follow two different
methods of evaluation and computation of results in respect of
students who had appeared for same Examination, which would
be in violation of principles of equality enshrined in Article 14 of
Constitution of India.
16. It was submitted that RGUHS had arbitrarily changed
procedure of evaluations and computation of results only in
respect to odd batch of students, whilst applying earlier
procedure to regular RS-3 students. Therefore, impugned
Amended CAP-2022, was entirely arbitrary and illegal and
sought for allowing writ petition.
17. Sri Aditya Sondhi, learned Senior Counsel appearing
for Sri Parashuram A.L., advocate for petitioner in
W.P.no.19983/2023, submitted that petitioners therein were
153 students of RS-3 batch. It was submitted that bare perusal
of Digital Valuation Slips at Annexure-F would clearly
demonstrate erratic evaluation. It was submitted that CAP-
2022 issued on 05.09.2022 under Section 35 of RGUHS Act

would apply to RS-3 students also and prescribed valuation by
two evaluators with highest among them considered for results.
18. It was further submitted that July, 2023
Examinations was supplementary to Main Examination
conducted in February, 2023. When main examinations were
conducted following CAP-2022, Supplementary Examination
could not be governed by different yardstick. It was submitted
that last date for payments of examination fee was 12.06.2023
as per Annexure-B, whereas, Amended CAP-2022 was
promulgated on 13.06.2023. Therefore, applying it to
petitioners who had taken supplementary examination would
be arbitrary. It was submitted that ratio in Thejaswi Ketham's
case (supra) could not be applied as validity of CAP-2022 was
decided therein and prayers sought were dissimilar.
19. It was submitted that when other batch mates of
petitioners has passed in main Examinations while being
governed CAP-2022 Regulation, it would be arbitrary and
violative of Article 14 of Constitution of India, if different
Regulations were to be applied to petitioners. It was submitted
that none of petitioners were parties in Ricardo

Konjengbam's case (supra), while RGUHS was a party and
issued Circular dated 04.05.2023 to comply with interim order,
but thereafter under Amended CAP-2022 sought to exclude
entire RS-3 students from scope of CAP-2022. Therefore, it
would only be appropriate to apply Amended CAP-2022
prospectively. It was submitted that method of evaluation and
computation of results under CAP-2022 was more beneficial to
students as highest marks among evaluators will always be
higher than average marks of all evaluators. It was submitted
that when two interpretations were possible, one which was
favourable to students was required to be preferred. On above
grounds, learned Senior Counsel sought for allowing writ
petition.
20. On other hand, Sri N. Khetty, learned counsel for
NMC sought to oppose writ petition. It was submitted that all
petitions were covered by decisions in Basanth K.B.,
Nireeksha, Jordan Ridhay Rasquinha, Neelesh Mehta
culminating in Thejaswi Ketham cases (supra). It was
submitted that prayer (b) sought in present writ petition was
identical to prayer (b) sought in Thejaswi Ketham's case

(supra). It was submitted that 19 petitioners therein were also
petitioners herein, but, they had suppressed said fact from this
Court. Further, observations in para nos.23 and 29 in said case,
would indicate that petitioners therein had filed petitions even
earlier. It was pointed out that by deliberately not either
referring to Thejaswi Ketham's case (supra) and producing
order copy passed therein, present petitioners were guilty of
suppression of material fact and for having approached this
Court without clean hands. Hence, sought for dismissal of writ
petition by imposing exemplary costs.
21. It was submitted that petitioners at earlier point of
time had sought that they be granted benefit of evaluation by
four valuators as per MCI Regulations and directions were
issued for two additional valuations. Having taken benefit of
said directions and passed in some subjects, in respect of
subjects in which they failed, petitioners were once again
pleading for computation of results by taking average of two
highest marks out of four or five evaluations, as case may be.
It was vehemently submitted that CAP-2022 was irrelevant for
evaluation and computation of results of RS-3 Scheme

students, as it was held in Dr.Preethi Srivatsa and Anr. v/s
State of M.P and Others8, that Regulation no.13(2) of MCI
Regulations being Central Legislation would prevail over RGUHS
Ordinance. It was submitted that at time of passing judgment
in Thejaswi Ketham's case, CAP-2022 was already in
existence and that law declared by Court had rendered CAP-
2022 otiose. It was submitted that RGUHS had perhaps
realising same had issued Amended CAP-2022.
22. It was further submitted that after decision in
Thejaswi Ketham's case, when RGUHS breached Regulation
13(2) of MCI Regulation, 1997, NMC had reprimanded it
prompting corrective measure. It was submitted that July, 2023
Examinations were conducted by applying Regulation 13(2) of
MCI Regulation, 1997, uniformly in respect of all RS-3 Scheme
students including petitioners, both who had passed and failed
in some subjects by following uniform method of computing
results i.e., by taking average of valuations. Therefore, there
was no scope for petitioners to allege discrimination, as uniform
yardstick was applied.

23. It was further submitted that petitioners were MBBS
Students of 2014 Batch were virtually pursuing said Course for
nearly a decade, but still not progressed beyond II year. It was
submitted that new Regulations applicable after year 2019
permitted a maximum of four attempts in four years for
passing. In case of students, who did not pass would require to
discontinue Course. It was submitted that CAP-2022 was
obviously issued in breach of Regulation 13(2) of MCI
Regulation, 1997. Therefore, even if any student was declared
passed by applying said illegal Regulation, same would not
accrue any vested right to petitioners even on ground of
discrimination, as it would amount to perpetuating an illegality.
It was submitted initially it was held in Thejaswi Ketham's
case (supra), that computation of results was to be by taking
best of two evaluations out of four or five valuations, which was
set aside by Division Bench in Appeal and thereafter, Thejaswi
Ketham's case (supra) ended in dismissal of writ petition
upholding law that Regulation 13(2) of MCI Regulation, 1997,
would prevail. Hence, alternative prayer for taking highest
marks awarded by any one of evaluator for computing results
would be highly arbitrary and discriminatory, as such method

would enable them to secure more marks than other students
who had passed Examinations on basis of average score of all
evaluators taken together. Apart from same, being contrary to
law, would severely contradict submissions of petitioners
themselves. For above stated reasons, learned counsel sought
for dismissal of writ petition.
24. Smt.Farah Fathima, learned counsel for RGUHS also
opposed writ petition. It was submitted that in Dr.Menaka
Mohan's case (supra), this Court directed RGUHS to send
answer papers of such of petitioners therein, where difference
exists amongst valuation (two in case of UG Course and four in
case of PG Course) in terms of 15.06.2012 Ordinance, for third
and fifth Valuation, as case may be.
25. It was submitted that said judgment was passed on
21.12.2018. Thereafter RGUHS issued 2019-Ordinance on
29.03.2019, which provided for general valuation by two
evaluators and deviation valuation by third evaluator in case
difference was 15% or more of total marks of subject and
computation of result was best of two valuations out of three.

But, 2019-Ordinance was quashed in Neelesh Mehta's case
(supra) on 10.08.2020.
26. It was submitted that on 29.03.2019, RGUHS also
promulgated Ordinance Governing Valuation of P.G.
Medical/Dental and Diploma and Super Speciality Courses
which provided for General Valuation by four evaluators and
Deviation valuation by fifth evaluator in case of Deviation
between any two evaluators was equal to or more than 15% of
maximum marks prescribed for paper and computation of result
by average of best of four evaluation marks for paper.
27. It was submitted that in compliance with decision in
Neelesh Mehta's case (supra), RGUHS issued 2020-Ordinance
on 13.10.2020, which provided for valuation of answer scripts
of UG Courses by four evaluators and computation of result by
taking average of marks awarded by four evaluators. But, said
Ordinance was quashed by this Court in Basanth K.B.'s case
(supra) on 11.02.2021, wherein this Court directed valuation of
answer scripts of failed students of RS-3 Scheme on par with
PG Course Regulations (29.03.2019), i.e. valuation by four
evaluators and Deviation valuation by fifth evaluator in case of

Deviation between any two evaluators was equal to or more
than 15% of maximum marks prescribed for paper and
computation of result by average of total evaluation marks
awarded by four valuators for each paper.
28. It was submitted that on 01.02.2021, RGUHS issued
CAP-2021 Regulation for theory paper assessment of MBBS RS-
4 Scheme students. But, same was quashed in Sahana
Kalasagond & Others Vs. RGUHS9. On 19.04.2022, this
Court in Disha Vivek & Others Vs. RGUHS & Another10,
followed Nireeksha's case (supra) in respect of failed students
of RS-3 for February, 2022 Examination. Similar orders were
passed in Anusha L.G. Vs. RGUHS11 and in Sanjna Hedni &
Others. Vs. RGUHS & Another12. Same was followed in
Rahul V. Reddy & Others Vs. RGUHS & Another 13 and in
Nireeksha's case (supra) in respect of failed students of RS-3.
In said petition specific prayer for computing result based on
highest of two evaluation marks from amongst four or five
valuation marks was not entertained.

29. It was submitted that on 27.07.2022, this Court in
Jordan Ridhya Risquinha's case (supra), dismissed writ
petition, wherein identical relief for declaration of results by
taking highest marks awarded by four or five evaluators,
sought by students, who had got benefit of fourth and fifth
valuation in February, 2022, Examinations and results were
declared based on average marks. It was submitted that
RGUHS thereafter conducted Supplementary Exams in July,
2022 for RS-3 students, who had failed in February, 2022,
Examinations without demure. Thereafter on 05.09.2022,
RGUHS promulgated CAP-2022, Regulations for all UG Courses.
It was submitted that in Thejaswi Ketham's case (supra),
petitioners had sought for additional valuation as per
Regulation 13(2) of MCI Regulation, in failed subjects of MBBS
Exams held in July-August, 2022. Said writ petition was initially
allowed by learned Single Judge on 22.09.2022. But, in
W.A.no.57/2023, said order was set-aside and matter
remanded back for fresh consideration. In meanwhile, RGUHS
conducted February, 2023 Examinations for RS-3 and RS-4

Scheme students as per CAP-2022. On 01.02.2023, Thejaswi
Ketham's case (supra) ended in dismissal.
30. Thereafter, in Ricardo Konjengbam's case (supra),
filed by RS-3 students, CAP-2022 was challenged. Though,
interim order was granted on 19.04.2023, after RGUHS issued
Amended CAP-2022 Regulation excluding RS-3 students from
CAP-2022 Regulation. Taking note of same, writ petition was
disposed of. Subsequently, in July-August, 2023, RGUHS
conducted Exams for RS-3 Scheme Students and valuation was
done as per Regulation 13(2) of MCI Regulations and declared
results by taking average of four valuations. Petitioners having
been declared failed as per above valuation, have come up with
new grounds though with slightly different prayers, but with
same intention - to somehow pass Examination. Therefore,
petitioners do not deserve any consideration.
31. Heard learned Counsel and perused writ petition
record.
32. From above, it appears that prior to 2017 Ordinance,
15.06.2012 Ordinance governed all MBBS Examinations

conducted by RGUHS. In Dr.Menaka Mohan's case (supra),
2017 Ordinance was quashed and RGUHS was directed to
conduct evaluation of Answer Scripts of MBBS students by
following 15.06.2012 Ordinance. Subsequent, 2020 Ordinance
was quashed in Basanth KB's case (supra), with direction to
apply PG Regulations to UG Courses also. Thereafter i.e. CAP-
2021 was held not applicable to RS-3 students in Nireeksha's
case (supra), and quashed altogether in Sahana Kalasagond's
case (supra).
33. Next regulations promulgated were CAP-2022, which
provided for evaluation by two evaluators and declaration of
results by taking highest total marks among two evaluators.
Same was challenged in Ricardo Konjengbam's case (supra)
with prayer for evaluation as per Regulation 13 (2) of MCI
Regulation. On appreciation of contentions, interim order was
granted directing RGUHS to conduct two additional valuations,
in case of failed students of RS-3 batch. After complying with
interim order, it issued Amended CAP-2022 Ordinance,
purporting to exclude RS-3 Students from purview of CAP-
2022. Therefore, challenge against CAP-2022 on ground of

deviating from MCI Regulation 13(2) in Ricardo
Konjengbam's case (supra) was dismissed as infructuous.
34. From above, it is seen that one of grievances
espoused in these cases is about erratic valuation to
substantiate need for revaluation. It is vehemently contended
that marks awarded to petitioners in failed subjects by different
evaluators would substantiate erratic valuation to press home
contention against withdrawal of right to seek revaluation,
under impugned Amended CAP-2022.
35. Normally, if academic excellence is to be promoted,
same has to be by a method of evaluation that aims at
accuracy in evaluation. In case of evaluation by multiple
valuators, such accuracy cannot be stated to be achieved by
considering highest marks among multiple evaluators. Accuracy
would lie where marks awarded by more or majority of
valuators group together. For e.g. if marks awarded by four
evaluators were to be as follows:
"1st Valuator = 45 Marks; 2nd Valuator = 47 Marks; 3rd Valuator = 70 Marks; and by 4th Valuator = 50 Marks, then marks awarded by 3rd valuator will have to be

considered as extreme and eliminated from process of consideration.
Likewise, 1st Valuator = 45 Marks; 2nd Valuator = 47 Marks; 3rd Valuator = 50 Marks; and by 4th Valuator = 17 Marks, then marks awarded by 4th valuator will have to be considered as extreme and eliminated from process of consideration."
36. Yet another, aspect that appears to have plagued
examination system in case of MBBS students is repeated and
in some cases hasty modification/amendment of regulations
governing Examinations, which has given rise to enormous
amount of confusion and consequent litigation. It would be
appropriate for Universities to initiate process of modification or
amendment of Regulations that affect students under going
Courses critically, well ahead of next academic year or
Examination and as far as possible make process more
democratic. And even after amending or modifying Regulations
to give wide publicity to same amongst students undergoing
Courses so that they are well aware of method of Examinations,
they would be preparing for. Once they appear for
Examinations, they would be deemed to have subscribed to
Regulations under which Examinations are conducted and

would be estopped from questioning them. Above observations
are in response to long history of litigation insofar as MBBS
Examinations as narrated by learned counsel for petitioners as
well as RGUHS.
37. But, though parties are at logger heads on various
aspects of Examinations namely, evaluation method, right of
revaluation and method of computation of results. Careful
perusal of prayers sought would indicate that relief sought is
confined only regard to method of computation of results.
38. First prayer i.e. for quashing of Amended CAP-2022
Ordinance insofar as July-August, 2023, MBBS Examinations is
on ground that it was issued after last date fixed for filing
examination applications i.e. with retrospective effect, which
power is alleged to be lacking with RGUHS under RGUHS Act.
39. W.P.no.19983/2023 is filed with specific prayers for
mandamus to re-compute results by taking highest total
valuation marks awarded from amongst valuators in terms of
CAP - 2022 Ordinance or by taking highest two marks awarded
from amongst valuators.

40. Said relief is sought on specific contention that
Amended CAP - 2022 having been notified on 13.06.2023 i.e.
after last date fixed for filing of application for July-August,
2023 Examinations, which was 12.06.2023, could not be
applied for said Examinations and consequently, petitioner was
entitled for declaration of results as per CAP-2022. However, as
per Notification dated 13.06.2023 produced as Annexure-C
therein, last date for filing Examination Application was altered
from 13.06.2023 to 17.06.2023. Hence, main ground urged by
petitioners of retrospective applicability of Amended CAP 2022
Ordinance would stand discharged insofar as July-August, 2023
Examinations.
41. By virtue of Amended CAP-2022, petitioners would
stand excluded from CAP-2022 and while valuation of their
papers would be in conformity with Regulation 13 (2),
computation of results would be by applying PG regulation i.e.
average of total valuation marks awarded by four valuators.
Further, RS-3 batch students were admitted to Course prior to
2018-2019, when valuation of answer scripts was governed by
Regulation 13(2) of MCI Regulation. Thereafter NMC granted

autonomy to respective Universities to device own methods of
valuation, but reduced maximum number of attempts to four
within which they were required to pass Exams to progress for
next year of Course. Hence, there would be sufficient
justification for RGUHS to exclude RS-3 students from purview
of CAP 2022 under Amended CAP 2022.
42. It is also impugned on ground of discrimination as
Examinations conducted in January-February, 2023 are stated
to be Main Examinations, applying CAP-2022 Ordinance i.e.
evaluation by two valuators and declaration of results on basis
of highest total marks awarded from amongst two valuators.
While in case of Supplementary Examinations held in July-
August, 2023, RGUHS sought to apply different method of
evaluation/computation of results.
43. It is alleged that this Court in Ricardo
Konjengbam's case (supra), filed by failed RS-3 MBBS
students questioning CAP-2022 Regulation, an interim order
was granted on 19.04.2023 directing RGUHS to provide two
additional valuation of Answer Scripts of January-February,
2023 Examinations and also provide right for revaluation in

case of difference between two valuations being more than
15%. It is alleged that having implemented said interim order
by issuing Circular, dated 04.05.2023, under impugned
Amended CAP-2022 Ordinance, RGUHS had sought to exclude
RS-3 batch students from CAP-2022 Ordinance, by providing
separate method of evaluation of Answer Scripts of RS-3 MBBS
students as per Regulation 13 (2) of MCI Regulations, 1997 and
Basanth KB's case (supra). As per same, evaluation of Answer
Scripts of RS-3 batch students would be by four valuators and
computation of results as directed in Basanth KB's case
(supra) applying PG Regulations i.e. average of highest three
total marks out of four valuators or average of highest four
total marks out of five valuators in case of revaluation, as case
may be. Where University conducts Examinations under
Regulations framed prior to last date fixed for filing
Examination forms, valuation done under same uniformly in
respect of all students in all subjects and results declared,
would not be open for challenge on ground of discrimination.
44. Second prayer sought by petitioners is for
declaration of results by considering only highest total marks

awarded from amongst evaluators. Said method of computation
of results is provided in CAP-2022, but which right is obstructed
by Amended CAP-2022 insofar as RS-3 students. Though it is
mentioned in Amended CAP 2022, that it would be applicable
with retrospective effect from 01.09.2022, and would appear to
be contrary to decision in Neelesh Mehta's case (supra), since
subject matter of these writ petitions is July-August, 2023
Examinations, in view of finding hereinabove, said contention
would not be available to present petitioners.
45. Third prayer sought is for re-computation of results
of July - August, 2023 MBBS Examinations (RS-3) in
compliance with decisions in case of Neelesh Mehta and
Basanth K.B's cases (supra), but by taking highest two total
marks from amongst four or five valuators, as case may be
applying provision for revaluation. But, this Court in Neelesh
Mehta's case (supra) was considering validity of 2019
Ordinance and prayer for providing revaluation option as per
Dr.Menaka Mohan's case (supra). However, directions issued
in Neelesh Mehta's case (supra) was valuation of Answer
Scripts by four valuators in terms of Regulation 13(2) of MCI

Regulations, 1997, with provision for revaluation as granted in
Dr.Menaka Mohan's case (supra). And in Basanth K.B's
cases (supra), this Court quashed 2020 Ordinance and issued
direction to follow PG Regulations as per which declaration of
results would be by average of highest three out of four total
valuation marks or average of highest four out of five total
valuation marks in case of revaluation.
46. But, petitioners seeks to modify method in Neelesh
Mehta and Basanth K.B's cases (supra) only insofar as
computation of results, i.e. by taking average of highest two
total marks awarded from amongst valuators, which would be
contrary to directions issued in Neelesh Mehta and Basanth
K.B's cases (supra) and therefore, cannot be granted.
Moreover, in Thejaswi Ketham's case (supra), prayer for
computation of results by taking average of two highest marks
amongst marks awarded by four or five valuators in respect of
MBBS RS-3 students was dismissed.
47. Further, fourth prayer, wherein petitioners have
alternatively sought for declaration of results as per Basanth
KB or Neelesh Mehta's cases (supra) by applying Amended

students would be directly contradictory to first prayer.
48. Interestingly, under Amended CAP-2022, valuation
of Answer Scripts of MBBS RS-3 batch students would be in
compliance with Regulation 13(2) of MCI Regulations, 1997
with no provision for computation of results of MBBS RS-3
students.
49. Therefore, overall consideration of contentions urged
and decisions relied upon would indicate a strong inclination by
petitioners-students to somehow pass Examinations,
sometimes nit-picking on provisions regarding method of
evaluation, sometimes seeking right of revaluation and as in
present case by seeking to tailor Regulations to suit petitioners
to pass Examinations, which would be a matter of great
concern, as petitioners are pursuing Course in Medicine and
would be dealing with health of people.
50. While not denying right to students if aggrieved by
any rule/regulation or Ordinance to challenge same, it requires
to be observed that such right cannot be wanton, but depend

upon their conduct. As per decisions of Hon'ble Supreme Court
in Om Prakash Shukla Vs. Akhilesh Kumar Shukla 14,
principles of estoppel would apply even to students who appear
for Examinations conducted as per Regulations formulated prior
to date of commencement of Exams. Ratio in said decision has
been reiterated and followed in several later cases, especially in
cases where candidates appear for exams for selection to
employment posts:- [Ashok Kumar vs. State of Bihar15;
Chandra Prakash Tiwari vs. Shakuntala Shukla 16; Union
of India vs. S. Vinodh Kumar17; Amlan Jyoti Borooah
vs. State of Assam18; Madras Institute of Development
Studies vs. K.Sivasubramaniyan19; Manish Kumar Shahi
vs. State of Bihar20;Chandigarh Admn. vs. Jasmine
Kaur21; Taniya Malik vs. High Court of Delhi22; K.H.
Siraj vs. High Court of Kerala23.
51. Indisputably, petitioners who are seeking for re-
computation of results (in various alternative manners) have

come up with same only after appearing for Examinations
without demur and seeking relief only in respect of failed
subjects; while retaining benefit of method of evaluation and
computation of results insofar as subjects in which they have
passed applying very same impugned Regulations.
52. It is also spaciously contended that directions issued
in earlier decisions cited above including interim order in
Ricardo Konjengbam's case (supra) were only in respect of
failed subjects, whereas RGUHS had subjected all papers of all
RS-3 students to valuation by four valuators and declared
results, would also not stand to reason, since in Basanth KB's
case (supra), this Court has held valuation would require to be
in compliance with Regulation 13 (2) of MCI Regulations, 1997
and PG Regulations.
53. Thus, it has to be construed that prayers/directions
sought are for method for computation of results tailored to
enable petitioners to pass Examinations, by relying upon
decisions wherein subject matter was only in respect of
valuation and re-valuation and no specific directions were
issued insofar as method for computation of results. Thus,

there would be no justification for demand by petitioners to
follow one set of regulations for evaluation and re-valuation
and another for computation and declaration of results. Scope
of power under Article 226 of the Constitution of India would
not extend to tailoring procedure to suit particular needs of
students nor would petitioners be entitled to seek such reliefs.
54. In view of above findings, Writ Petitions are not
meritorious and stand dismissed.
