The Inspector General of Police accompanied by the
Superintendent of Police have preferred this writ petition for
laying a challenge to the Karnataka State Administrative
Tribunal's order dated 07.01.2022, whereby private respondent's
Application No. 3608/2019 having been favoured, he was
directed to be reinstated into service with all consequential
benefits except arrears of salary, and that certain liberty was
given to the petitioners herein for other proceedings.
2. Learned AGA appearing for the petitioners
vehemently argues that the private respondent, an employee of
the Police Department was habitually absent without any
justification whatsoever; that in defence & Police forces,
absenteeism per se, involves malus since it has potential to be
contagious and to destroy the discipline & efficacy of the
department and therefore, only his removal by way of
compulsory retirement has been ordered. He adds that in view of
the qualifying service having been put in, the pension is being
paid regularly to the private respondent and at present he is

drawing a sum of Rs.14,200/- per month. All these aspects,
having not been duly adverted to by the Tribunal, there is error
apparent on the face of the impugned order warranting
interference of this Court.
3. Learned counsel appearing for the private respondent
per contra submits that the impugned order is unassailable
especially when liberties are left to the officials to take
appropriate action after reinstating his client into service; the
impugned order of compulsory retirement was directed was
apparently flawsome in as much as the multiple incidents for
which the private respondent had already undergone punishment
have also been counted; for whatever subsequent absence he is
accused of, he had already offered proper explanation. He
further adds that all though his client is drawing regular pension
on the basis of compulsory retirement, that he had reserved
liberty to assail the said penalty order and therefore, that would
not come in the way of prosecuting his cause before the
Tribunal. So contending, he seeks dismissal of the writ petition.
4. Having heard the learned counsel for the parties and
having perused the petition papers along with the original

records on request produced by the learned AGA, we are inclined
to grant indulgence in the matter for the following reasons:
5. The Hon'ble Apex Court in L. Chandrakumar v. Union
of India (1997) 3 SCC 261 has specifically observed that the
power of the Tribunals constituted under the provisions of the
Administrative Tribunals Act, 1985 have the characteristics of
writ jurisdiction and therefore, whatever constraints that apply to
the exercise of constitutional jurisdiction would apply to the
Tribunals as well. A perusal of the impugned order gives an
impression that the Tribunal acted not as a supervisory body
exercising jurisdiction under Articles 226 & 227 of the
Constitution of India while framing the impugned order, but it sat
in appeal over the orders of penalty. It failed to see that the
private respondent had availed multiple remedies at the level of
department itself and all they had proved futile. In Sadhana
Lodh v. National Insurance Co. Ltd. And Another (2003) 3 SCC
524 it is observed that merely because there are errors of fact or
of law, the writ Courts cannot grant interference. These
principles having not been borne in mind while making the
impugned order. Thus, there are errors apparent on its face.

6. We had taken extra pains in framing this judgment;
we had requested the learned AGA to place before us the original
file relating to the private respondent which, he graciously did.
At page 8 of the original file, the delinquent acts of the
respondent in all amounting to 25 have been enlisted. For ease

7. The above track record in a Police force cannot be
fully lost sight off while judging the subsequent absence,
notwithstanding the fact that for the previous delinquencies the
employee was punished in as much as he did not mend his ways.
It has been the consistent view of Apex Court that persons
employed in forces have to be very scrupulous & punctual and
that in no circumstance they will leave the assignment spots
sans permission. One of the entries for the period covering
09.01.2001 to 16.01.2001 shows that the respondent had left
the security duty of 1st Gate of TB Dam and this is very serious,
regard being had to danger potential involved, even this aspect
of the matter has not been discussed by the Tribunal which has
treated the case of respondent as if one of some minor
delinquency. Due seriousness is apparently lacking in the

impugned order and that amounts to added error apparent on
the face of the record.
8. The vehement submission of the learned counsel
appearing for the respondent-employee that the previous track
record stands wiped out once the punishment has been levied for
the delinquencies, appears to be attractive at the first blush.
However, its untenability becomes apparent by a deeper
examination; that the charges concerned related to fresh period
and not to the previous one at all. Contra submission of the
learned counsel for the respondent does not convince us. This
gains credence from what is stated at paragraph No.5 of the
affidavit of the Superintendant of Police filed in pursuant to the
order of this Court on 03.04.2024, which reads as under:
"5. It is submitted that, the respondent while working as a District Armed Police Constable, habitual absent from the duty on several occasion which is as below:-

For these unauthorized period, the department has imposed certain punishment including minor punishment of postponing of annual increments for the period of 1 year and said un authorized absence period is treated as Leave without Pay (LWP) and censure, warning also given, in spite of imposing such punishment, the respondent has continued to be unauthorized from duty without any valid reasons and the respondent once again absent from duty for several occasion including from the date of 02.08.2005 to 07.09.2005 for the period of 37 days and 22.09.2005 to 11.11.2005 for period of 51 days and 05.12.2005 to 07.04.2006 for period of 124 days."
9. The Apex Court in Chennai Metropolitan Water
Supply and Sewerage Board v. T.T.Murali Babu (2014) 4 SCC
108 and in State of U.P. and Others v. Ashok Kumar Singh and
Another (1996) 1 SCC 302 has frowned upon the High Courts in
granting interference in matters of the kind when direction for
reinstatement in service was given. Our above view gains
support from the observations made in these judgments. Added,
the respondent-employee has been drawing regular pension

every month in a sum of Rs.14,200/- which is more than the
minimum wages notified by State Government for industrial
workers.
In the above circumstances, this petition being meritorious
is entitled to be allowed and accordingly it is; the impugned
order of the Karnataka State Administrative Tribunal, Belagavi is
quashed by issuing a writ of certiorari and further, the
respondent's Application No.3608/2019 is dismissed. Costs made
easy.
This Court appreciates the meticulous way of prosecuting
the case by the learned counsel appearing for the respondent.
