       This MFA is filed und er Section 54(1) of Land
Acquisition    Act,    ag ainst    the     Judgment      and   award
dated 26.02.2020 passed in LAC No.2/1993 on the file
of    the   Additional    Senior        Civil    Judge   and    CJM,
Tumakuru, p artly allowing the reference petition filed
und er Section 18 of the Land Acquisition Act.

       This MFA coming on for orders through video
conference this d ay, the Court made the following:

                            ORDER

The office has raised objection with regard to

maintainability of the appeal, in view of pecuniary

jurisdiction of this Court. According to Registry,

this appeal should be preferred before the District

Court, in view of valuation being less than Rs.10

lakhs.

2. Now counsel for the appellant seeks

permission of withdraw this appeal and present the

same before the concerned District Court. Hence :: 3 ::

permission is accorded. Appeal memo shall be

returned to the appellant's counsel for being

presented before the concerned District Court.

3. The Court fee paid here by the appellant

shall be transferred to the concerned District

Court.

4. If the appeal is presented before the

concerned District Court within 30 days from

today, question of limitation will not arise.

This appeal stands disposed of for statistical

purpose.
