                        JUDGMENT

Memo is preferred seeking withdrawal of the appeal as

the matter is settled out of Court. Memo for withdrawal is

signed by the appellant and countersigned by his counsel.

2. Memo reads as under:-

"MEMO FOR WITHDRAWAL OF THE APPEAL

The above appeal is filed challenging the Judgment and Decree made in O.S. No.122/2012 on the file of IIIrd Addl. Senior Civil Judge & JMFC, Davanagere, dated 14.03.2014. In the above appeal notice was issued and after service of notice the Respondent settled all the claims made by the Appellant during the month of April 2022. In view of the same the Appellant is intending to withdraw the appeal. Accordingly he may be permitted to withdraw the appeal.

3. Memo is placed on record and the submission of

the learned counsel is taken on record.

4. Appeal is dismissed as withdrawn.

5. Office to draw-up a decree accordingly.
