      This Regular Second Appeal is filed under Section 100 of
CPC against the judgment and decree dated 12.07.2010 passed
in RA No.366/2008 on the file of the Presiding Officer, Fast
Tract Court-V, Madhugiri, allowing the appeal and setting aside
judgment and decree dt:15.3.2008 passed in OS.No.71/1993
on the file of the Civil Judge (Sr. Dn.) & JMFC., Madhugiri.

      This appeal coming on for Dismissal, this day, the Court
delivered the following:


                         JUDGMENT

1. Sri S.R.Sreeprasad, learned Counsel for the

appellant, on instructions, submits that the dispute

between the parties has been settled out of court and he

has got instructions to withdraw the appeal and prays to

dismiss the appeal as withdrawn. He submits that

necessary memo will be filed to the said effect in the

Registry within a day.
