Heard the parties.
Learned counsel for the appellant submits that this interlocutory application has been filed with the prayer to release the appellant on bail after suspending the sentence during the pendency of this appeal. It is next submitted that the appellant has been convicted and sentenced by the learned Special Judge, NDPS Act, Khunti by the Judgment of conviction dated 19.04.2025 and order of sentence dated 23.04.2025 in connection with NDPS Case No.38 of 2020, arising out of Saiko P.S. Case No. 19 of 2020 as under:-
Offence u/s Sentence Fine Default 18 of the R.I. for five years Rs.30,000/- S.I. for three NDPS Act months 25(1-b)a/35 of R.I. for three years Rs.10,000/- S.I. for one the Arms Act month 26/35 of the R.I. For three years Rs.10,000/- S.I. for one Arms Act month
All the sentences were directed to run concurrently. It is next submitted that during the pendency of the appeal, the appellant was in custody from 11.07.2020 to 03.08.2021 and he was on bail on the date of judgment on 19.04.2025 but after his conviction, he has been taken into custody.
The allegation against the appellant was that from the co-accused persons 1 Kg of opium which comes under intermediate quantity and from the possession of the appellant a loaded country made pistol with three cartridges were recovered. It is next submitted that the appellant has very good ground to agitate in this appeal and there is no likelihood of this appeal being disposed of in near future. The appellant undertakes to cooperate with the hearing of the appeal.
Considering the facts of the case, the appellant, named above, is directed to be released on bail till disposal of this appeal on furnishing bail bond of Rs.25,000/-(Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Khunti in connection with NDPS Case No.38 of 2020, arising out of Saiko P.S. Case No. 19 of 2020 with the condition that he will co- operate with the hearing of the appeal.
This Interlocutory Application is allowed accordingly.
