-----

For the Petitioner: Mr. Indrajit Sinha, Advocate Mr. P.A.S. Pati, Advocate For the Respondents: Mr. Piyush Chitresh, A.C. to A.G.

-----

02/23.03.2026

1. Heard learned counsel for the parties.

2. The primary argument on behalf of the petitioner is that the

impugned show cause notice was issued pursuant to directions

issued by this Court in W.P (C) No. 4462 of 2022 dated 18th

September, 2025 and analogous matters.

3. Learned counsel for the petitioner has now pointed out that the

above referred order made by this Court has been stayed by the

Hon'ble Supreme Court in Petition(s) for Special Leave to Appeal

(C) No(s). 1585-1586 of 2026 on 2nd February, 2026. Accordingly,

the learned counsel for petitioner has urged that the impugned

show cause notice must be kept in abeyance until the Hon'ble

Supreme Court decides the Special Leave Petition(s) one way or

the other.

4. Mr. Piyush Chitresh, learned A.C. to A.G., on instructions from the

District Mining Officer, Pakur, states that the impugned show cause

2026:JHHC:8007-DB

notice will not be proceeded with until the disposal of the above

referred Special Leave Petitions. The statement is accepted and the

District Mining Officer is directed to act accordingly.

5. With this, the grievances of the petitioner stand redressed and the

present writ petition is accordingly disposed of.

6. No costs.
