Order No:-10 Dated:-17-03-2026 I.A. No.4315 of 2025 in Cr. Appeal (SJ) No.484 of 2025 with I.A. No.7104 of 2025 in Cr. Appeal (SJ) No.330 of 2025 with I.A. No.5578 of 2025 in Cr. Appeal (SJ) No.408 of 2025 with I.A. No.4363 of 2025 in Cr. Appeal (SJ) No.421 of 2025 Heard the parties.

Learned counsel for the appellants submits that these interlocutory applications have been filed with the common prayer to suspend the sentence dated 21.03.2025 passed by the learned Special Judge, Cyber Crime, Jamtara in connection with Cyber Case No.12 of 2019 arising out of Jamtara Cyber Crime P.S. Case No.40 of 2018 whereby and where under each of the appellants have been convicted of the offences punishable under Sections 419, 420 and 120B of the Indian Penal Code and Section 66 (D) of the Information Technology Act and each of them have been sentenced as under:-

Learned counsel for the appellants submits that it has also been ordered that all the sentences were to run concurrently. It is next submitted that all the appellants along with the co-accused persons were on bail on the date of judgment i.e., 19.03.2025 and all the appellants have been in custody during the trial and after conviction taken together for more than sixteen months. It is further submitted that the appellants have very good grounds to agitate in these appeals and there is no likelihood of the hearing of these appeals in near future. It is also submitted that the appellants undertake to co-operate with the hearing of these appeals. Hence, it is submitted that the appellant be enlarged on bail.

Considering the facts of the case, the appellants, named above, are directed to be released on bail till disposal of these appeals on furnishing bail bond of Rs.25,000/-(Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, (Cyber Crime), Jamtara in connection with Cyber Case No.12 of 2019 arising out of Jamtara Cyber Crime P.S. Case No.40 of 2018 with the condition that they will co-operate with the hearing of these appeals.

Accordingly, these Interlocutory Applications are allowed.
