02/17.03.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The Petitioner has approached this Court for grant of regular bail in connection with Chaibasa Sadar P.S.Case No. 67/25, registered for the offence under Section 309(6) of B.N.S., 2023.

3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of suspicion and nothing has been recovered from the conscious possession of the petitioner. He further submits that other similarly situated co-accused, Shiva Samad @ Foto has already been granted bail by this Court vide order dated 18.02.2026 in B.A. No. 10983 of 2025. He further submits that the petitioner is languishing in custody since 04.09.2025; as such, the petitioner may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court.

4. Learned A.P.P opposes the prayer for bail of the Petitioner.

5. Having regard to the facts of the case and looking to the allegation made against this petitioner, coupled with the fact that similarly situated co-accused person has already been granted bail and also the fact that the petitioner is languishing in custody since

04.09.2025; I am inclined to enlarge the Petitioner on bail. Accordingly, the above-named Petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of C.J.M., Chaibasa, in connection with Chaibasa Sadar P.S.Case No. 67/25.

6. It is made clear that the Petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this Petitioner, learned trial court shall be at liberty to cancel the bail of this Petitioner.
