     1.             Heard the parties.

2. The petitioner has challenged the order of dismissal from service.

3. A criminal case was instituted against the petitioner and several others under Sections 419/420/467/468/471/120B of the IPC on the ground that the petitioner had obtained service on the basis of forged documents. The criminal case ended in acquittal exonerating the petitioner from the criminal charge.

4. In the similar matter, this Court in writ petitions being WP(S) Nos.2487 of 2020, 3981 of 2024 & 3980 of 2024 considering the acquittal of the petitioners, directed the petitioners to approach before the Appellate Authority to bring to the notice of the Appellate Authority about the order of acquittal and the Appellate Authority was directed to take a decision thereafter.

5. Thus, considering the facts that the petitioner is

2026:JHHC:1364 acquitted in the criminal case and the other similar set of employees have been relegated to the Appellate Authority, I direct the petitioner also to approach the Appellate Authority within a period of six weeks by filling a detailed representation, annexing copy of all the documents which is in favour of the petitioner. The Appellate Authority will consider the case of the petitioner taking into consideration the judgment of acquittal of the petitioner and pass an appropriate order.

6. With the aforesaid observations, this writ petition stands disposed of.
