Oral Order 05 / Dated : 09.01.2026 Instant civil misc. Petition has been filed under Section 152 of CPC for correction of typographical error in the judgment passed by this Court in S.A. No. 186 of 2006 dated 04.01.2022.

It is submitted by learned counsel for the petitioners that Plot No. 408/382 has been wrongly typed as Plot No. 908/382 in para-2 of the judgment.

On perusal of the judgment passed by the Trial Court as well as the judgment passed in M.A. No. 71 of 2004 on 09.05.2006, it is apparent that Plot No. 908/382 was not the subject matter of the suit property and it was Plot No. 408/382 regarding which the relief was claimed and the judgment and decree was passed. The defect is purely typographical in nature and will not cause any prejudice.

Under the circumstance, the judgment and decree passed in S.A. No. 186 of 2006 is modified to the extent that "Plot No. 908/382" as appearing in para-2 and elsewhere of the judgment will be read as "Plot No. 408/382".

This order shall always form part of earlier order dated 04.01.2022. This civil misc. Petition stands disposed of.
