Order No.07 / Dated : 07.01.2026 Bail petition filed on behalf of the petitioner- Roshan Minz, who is in custody since 21.09.2024 in connection with S.T. No.798 of 2024 arising out of Ratu P.S. Case No. 01 of 2009 corresponding to G.R. No.16 of 2009 for the offence registered under Section 376 (2)(g) of the IPC pending in the Court of learned Additional Judicial Commissioner-XV, Ranchi is pressed into motion.

It is submitted by the learned counsel on behalf of petitioner that he had no knowledge about this case and after he got to know that processes were issued against him, he voluntarily surrendered before the learned trial Court on 21.09.2024. It is further submitted that the co-accused, who was arrested immediately after the incidence, was put on trial in S.T. No.648 of 2009 and has been acquitted by the learned trial Court vide judgment dated 1st July, 2010. Prosecutrix in the said case was declared hostile as she stated that no such incidence took place with her.

Learned A.P.P. opposed the bail petition. It is submitted that the petitioner has absconded after the incidence and has appeared fifteen years after the incidence only after the process under Section 83 of the Cr.P.C. was issued against him.

It appears that the co-accused, who was put on trial, has been acquitted as the prosecutrix had turned hostile. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
