2/10.02.2026 Heard learned counsels for petitioner and for State.
2. The petitioner is apprehending his arrest in connection
with Gumla P.S. Case No.311 of 2025, for offence registered under
section 21(a), 22(a) and 29 of NDPS Act, pending in court of
learned Sessions Judge-cum- Special Judge, NDPS Act, Gumla.
3. Learned counsel for petitioner submits that the petitioner
has been falsely implicated in this case and 1.50 gram brown sugar
was recovered from the possession of Shubham Kumar and Sanju
Oraon. He next submits that even the quantity of the said
contraband is small and the co-accused person has been granted
anticipatory bail in ABA No.6817 of 2025. He also submits that the
motorcycle of the petitioner was parked near the water tank and
not near the house from where the recovery has been made.
4. Learned State counsel opposes prayer and submits that the
motorcycle of the petitioner was found there and in view of that,

the prayer for anticipatory bail of the petitioner may kindly be
rejected.
5. Looking to the contents of the FIR it transpires that
the said recovery of brown sugar was made from the possession of
Subham Kumar and Sanju Oraon and the quantity of the said
contraband is small and the co-accused has been granted
anticipatory bail as aforesaid and it has been pointed out that the
motorcycle of the petitioner was parked near the water tank and
not near the house from where the recovery has been made, I am
inclined to grant anticipatory bail to petitioner.
6. Accordingly, petitioner, above named, is hereby directed to
surrender before learned court within three weeks from today, and
in event of his surrender/arrest, petitioner, above named, shall be
released on bail, on furnishing bail bond of Rs.25,000/- (Rupees
Twenty Five Thousand), with two sureties of like amount each, to
satisfaction of learned Sessions Judge-cum- Special Judge, NDPS
Act, Gumla, in connection with Gumla P.S. Case No.311 of 2025,
subject to the conditions as laid down under section 482(2) of
Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
