I.A. No. 11599 of 2019 07/24.02.2026 Heard Ms. Vani Kumari, learned counsel for the appellant and learned Spl. P.P. for the State.

This interlocutory application has been preferred by the appellant for grant of bail to him during the pendency of this appeal.

The appellant has been convicted for the offences u/s 364, 302, 201/34 of the Indian Penal Code and has been sentenced to undergo R.I. for life along with a fine of Rs. 10,000/- for the offence u/s 302 of the Indian Penal Code.

Submission has been advanced by the learned counsel for the appellant that most of the co-convicts have been granted bail including Aashis Pati @ Ashish Pati whose case is similar to the present appellant and who has been granted bail in Criminal Appeal (D.B.) No. 844 of 2019. It has further been submitted that the appellant is in custody since the year 2017.

Learned Spl. P.P. has opposed the prayer for bail of the appellant but has not disputed the submission advanced by the learned counsel for the appellant.

Regard being had to the above, during the pendency of this appeal, the appellant is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned District & Additional Sessions Judge-I, Seraikella-Kharsawan in S.T. No. 41 of 2017/S.T. No. 31 of 2018.

I.A. No. 11599 of 2019 stands disposed of.
