This appeal is directed against the order dated 23.12.2025 passed by the learned Sessions Judge, Deoghar in B.P. No. 416 of 2025 arising out of Jasidih P.S. Case No. 350 of 2025 whereby and whereunder the prayer for bail of the appellant has been rejected.
It has been alleged that on information that some members of Inter-State gang were planning to commit theft of crude oil from the Haldia- Barouni pipeline, a raid was conducted in a hotel where the appellant and other accused persons were apprehended.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confession of the other co-accused and from the possession of the appellant a mobile was recovered from which a video footage of the Haldia Barouni pipeline had surfaced. So far as the recovery of the incriminating articles is concerned, the same is on the basis of joint confessional statements of the accused persons. Learned counsel adds that the appellant is in custody since 02.12.2025.
Learned Spl.P.P has opposed the prayer for bail of the appellant and on going through the case diary has submitted that the appellant had confessed about his involvement in the attempt of committing theft of crude oil from the Haldia-Barouni pipeline.
On consideration of the manner of implication of the appellant and the fact that the appellant does not have any criminal antecedents and recovery was effected only on the joint confession of the accused persons, we while setting aside the order dated 23.12.2025 passed in B.P. No. 416 of 2025 arising out of Jasidih P.S. Case No. 350 of 2025 by the learned Sessions
Judge, Deoghar, direct the appellant to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Deoghar in connection with B.P. No. 416 of 2025.
This appeal stands allowed and disposed of.
