1. The petitioner is an accused in the case registered for the

offence punishable under Section 108 of the Bharatiya

Nyaya Sanhita (BNS), 2023.

2. Learned counsel for the petitioner submits that the

petitioner has been falsely implicated in the present case

and has not committed any offence as alleged in the F.I.R.

As per allegation, being frustrated with the illicit

relationship of the petitioner with co-accused Jitendra

Ram, the petitioner's husband Rajesh Ram committed

suicide by hanging himself. It is further submitted that co-

accused Jitendra Ram has already been granted regular

bail by a Bench of this Court vide order dated 9th February,

2026 passed in B.A. No.11930 of 2025. The petitioner is in

judicial custody in connection with the present case since

13th October, 2025. Hence, she may be given the privilege

of regular bail.

3. Learned A.P.P. opposes the petitioner's prayer for regular

bail.

4. Having heard learned counsel for the parties and

considering that the aforesaid co-accused has already

been granted regular bail in connection with the present

case, I am inclined to enlarge the petitioner on bail.

5. Accordingly, the petitioner is directed to be released on

bail on furnishing bail bond of Rs.20,000/- (Rupees

Twenty Thousand) with two sureties of the like amount

each to the satisfaction of learned Chief Judicial

Magistrate, Garhwa in connection with Garhwa Nagar P.S.

Case No.471 of 2025.
